Description
This is a Sources Sought Notice only. The NF/SG Veterans Healthcare System, 1601 SW Archer Road, Gainesville, FL 32608 is conducting market research to determine the availability of small businesses capable of providing Specialized clinical and hematopathology testing for Gainesville VAMC. The applicable NAICS code is 621511. Interested contractors are requested to submit a capability statement outlining their ability to meet or exceed this potential requirement no later than 4:30 pm (Eastern Standard Time), August 14, 2013 stating their business size, as well as a point of contact. Interested contractors must be registered in SAM. The government will use the results of this announcement to determine whether the acquisition of the above described requirement should be solicited as a small business set-aside, or whether full and open competition procedure should be utilized. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES and no solicitation will be issued; This Sources Sought Notice is to assist the VA in identifying an appropriate acquisition strategy only. SEE STATEMENT OF WORK North Florida / South Georgia Veterans Health System Pathology and Laboratory Medicine Service STATEMENT OF WORK I. INTRODUCTION a. The North Florida/South Georgia Veterans Health System (NF/SG VHA) has an ongoing need to obtain referral testing services provided by a registered and/or licensed entity. It is VA's intention to solicit proposal in accordance with all terms, conditions, provisions, specifications, and schedules of this solicitation and award a firm fixed price requirements contract. b. The Contractor in accordance with the terms and conditions stated herein is to furnish to and/or at the NF/SG VHS, 1601 SW Archer Rd., Gainesville, FL 32608 the tests at the prices specified in the Fee for Service Schedule as published on http://www.cms.gov/Medicare/Medicare-Fee-for-Service-Payment/ClinicalLabFeeSched/clinlab.html which is Medicare allowable per the memorandum dated 09-13-2005. II. PERIOD OF PERFORMANCE a. This contract is effective for one calendar year from effective date of contract award with the renewal option for 4 more years. b. The contractor shall be required to begin providing supplies and services as required on effective date of contract award. III. SPECIFICATIONS Contractor laboratories provide specialized clinical and hematopathology testing that are not offered in house, provide timely and accurate invoices for the testing performed, provide documentation of results via a secure fax to the VA. IV. REQUIREMENTS a. Packaging, Processing and Transportation: Specimens shall be packaged and picked up from the Pathology and Laboratory Medicine Service of the North Florida/South Georgia Veterans Health System Veterans' Hospital, transported to the Contractor testing site, processed and tested in accordance with methods recommended in the current Standards. Specimens picked up will be processed, labeled appropriately and ready by the time the courier gets to the medical center. All specimens picked up at the Veterans Hospital under this contract shall be properly packed and insulated in such a way as to insure that the specimens shall remain within the temperature specifications during transport between the NF/SG VHS and the contractor's place of business. Contractor shall provide at least 3 daily scheduled courier pick-up services Monday thru Friday, 8 AM to 3 PM, and STAT specimen pick-up as needed 24 hours a day 7 days a week. b. Testing: Specimens will be tested in accordance with methods recommended in the current Standards and follow all regulatory requirements. c. Results: Contractor will report results in a timely manner within reasonable turn-around times by faxing a copy of the report thru a secure fax and/or by calling critical results directly to one of the Medical Technologists on duty. d. Performance: Customer services are to be available twenty-four (24) hours a day and seven (7) days a week. e. Quality Control: The contractor shall provide NF/SG VHA a monthly quality control report. f. The services specified in this solicitation shall be furnished to the VA by the contractor when requested by means of an individual written request which has been authorized by Chief, Pathology and Laboratory Medicine Service or his designees as listed below: VAMC, GAINESVILLE, FL Susan Alvarez Carmen Miskimen David Inman Carol Woodyard Sandra Pascual V. JCAHO, VHA (VETERANS HEALTH ADMINISTRATION) AND OTHER STANDARDS: a. The contractor shall notify the VA Contracting Officer immediately at the North Florida/South Georgia Veterans Healthcare System, 1601 SW Archer Road, Gainesville Florida 32608 (telephone no. 352-376-1611, X-3041 or fax no. 352-374-6117) of any change in the licensure, or status as non-excluded or sanctioned by HHS (Health & Human Services) Office of Inspector General of any personnel performing the services covered by the contract. No unlicensed, non-Medicare approved, uncertified or accredited entity or person shall perform services under this contract. Any change in status is grounds for immediate termination. b. The contractor shall immediately notify the Contracting Officer at the North Florida/South Georgia Veterans Healthcare System, 1601 SW Archer Road, Gainesville Florida 32608 of any merger, acquisition, or affiliation agreement; any legal or governmental action initiated against the contractor for professional negligence, violation of law, bankruptcy, lapse or material change in liability insurance coverage, any other problem or situation that might impair the ability of contractor to carry out its obligations under the contract. Any change in status is grounds for immediate termination. c. The contractor represents and warrants that it is in compliance with Medicare, Medicaid and any other related Federal or State Statutes, regulations, rules or policies and that neither they nor their agents, officers, employees, independent practitioners assignees or successors in interest are excluded from participation in the Medicare, Medicaid or related federal or state programs. Further, contractor shall immediately notify the Contracting Officer of the exclusion from such programs of any of its agents, officers, employees, independent practitioner's assignees or successors in interest. Such exclusions shall be grounds for immediate termination of the contract. d. The contractor must perform the required work in accordance with College of American Pathologists (CAP), Joint Commission on Accreditation of Health Care Organizations (JCAHO), OSHA, VHA HIPAA and/or any other regulatory standards. The contractor must comply with all annual updates as issued. e. The contractor shall conform to all issues addressed in the VA Medical Staff By-laws and the VA Medical Center Memorandums pertaining to delivery of services. f. Contractor agrees to maintain the minimum acceptable service, reporting systems and quality control as specified herein. Failure to comply with the specified terms and conditions and/or adverse reports from external monitoring agencies, which indicate poor quality of care, may be grounds for termination of the contract. Immediate (within 24 hours) notification must be given to VA regarding adverse reports and action by a regulatory agency. h. The services specified in the Schedule of Services may be changed by written modification to this contract. VA Contracting Officer will prepare the modification. i. The contractor shall furnish the services specified in the Schedule of Services to this contract to VA when authorized by VA Chief of Staff or designee. j. HIPAA: Contractor agrees to comply with the requirements of the Health Insurance Portability and Accountability Act (HIPAA) and with the provision of other appropriate federal laws, rule and regulations. k. Qualifications: Proposals shall be considered only from offerors whose Pathology and Laboratory Medicine Services are licensed as required by CLIA 88. l. License: Prior to award the offeror shall submit proof that he holds an un-revoked U.S. License which is issued required by CLIA 88. m. Certification: The offeror certifies that he shall comply with the requirements outlined with respect to donors, containers, delivery, etc. VI. INSPECTION OF OFFEROR'S FACILITIES: The right is reserved to thoroughly inspect and investigate the establishment and facilities and other qualifications of any offeror or to reject any proposal regardless of price, if it should be administratively determined as lacking in any of the essentials necessary to assure acceptable standards of performance. VII QUALIFICATIONS: a. Offers shall be considered only from offerors who are regularly established in the business called for and who, in the judgment of the Contracting Officer, are financially responsible and able to show evidence of their responsibility, ability, experience, equipment, facilities, and personnel directly employed or supervised by them to render prompt and satisfactory service in the volume required for all items under this contract. By the signing of this offer, offeror is certifying that he/she shall meet all requirements of Federal, State, or local laws, codes, and/or regulations regarding the operation of this type of service. b. VA will inspect the establishment, facilities, business reputation, and other qualifications of any offeror and reserves the right to reject any offer, irrespective of price, that shall be administratively determined by the Contracting Officer to be lacking in any of the essentials judged necessary to assure acceptable standards of performance. c. Any sub-contractor utilized by the contractor for the provision of services required under this contract shall meet the same qualifications specified herein for the contractor. The contractor shall obtain approval from the Contracting Officer for any sub-contractor to be utilized for the provision of services required under this contract. A subcontracting plan is required in accordance with Federal Acquisition Regulation Part 19. Any proposed subcontracting plans must be submitted with initial offers. d. Thirty (30) days prior to contract expiration date, the contractor shall certify in writing to the Contracting Officer that all licenses and registrations of personnel employed under this contract are valid and current and shall be renewed as necessary during any option period. VIII. PERSONNEL POLICY: The Contractor shall assume full responsibility for the training, certification and protection of its personnel furnishing services under this contract, in accordance with the personnel policy of the Contractor, such as providing worker's compensation, professional liability insurance, health examinations, income tax withholding, and social security payments. The parties agree that the contractor, its employees, agents, and subcontractors shall not be considered VA employees for any purpose. IX. CONFIDENTIALITY: a. VA will provide the contractor with access to pertinent patient medical information, within the existing privacy rules and regulations. Contractor shall ensure the confidentiality of all patient information and shall be held liable in the event of the breach of confidentiality. b. Any contract resulting from this solicitation will be subject to the Privacy Act of 1974. Federal Acquisition Regulations 52.224-1 Privacy Act Notification and 52.224-2 Privacy Act are provided in full text in the Addendum to FAR clause 52.212-4. The Contractor is not authorized to release any medical record information. The VA is the sole entity authorized to release this information upon written request from the patient. The C&A requirements do not apply and a Security Accreditation Package is not required. c. Any incidents of contractor noncompliance shall be forwarded immediately to the Contracting Officer. X. PAYMENTS AND INVOICING: a. All invoices will be paid monthly in arrears upon receipt of invoice. Each invoice shall indicate the month in which the items were delivered and the appropriate obligation number. b. VA will review the invoices and match them against VA bill validation report to verify that services were performed in accordance with solicitation. VA will notify the contractor of invoice discrepancies. Upon the resolution of the discrepancies, contractor shall submit a revised invoice; VA will verify revised invoice and make payment accordingly.
