Description
NRC Division of Contracts intends to negotiate and award an extension to BPA No. NRC-DR-33-16-317 with MAR, Incorporated for short-term continuation of that BPA and the associated and highly important Consolidated Information System Security Services (CISSS) task orders that were issued under that BPA until such time that the competitive follow-on task orders are awarded and to allow a reasonable time for adjudication of any protest(s) that may result from those awards. This short-term "bridge" extension of the current BPA orders, pending completion of the competitive award of the follow-on procurement, is a logical follow-on to the original FSS BPA orders in accordance with FAR 8.405-6(a)(1)(i)(C). The work to be performed is for the continued development of the NRC's cyber security program, and the original procurement was in accordance with applicable FSS ordering procedures and not done under sole-source or limited-sources procedures. Award to another source for this short term would most likely result in lapse of these vital services during the transition period and substantial duplication of costs to the Government that are not expected to be recovered through competition. It would be inefficient, uneconomical, and impractical to procure these follow-on services from, and transition to, another vendor for this short term, given the time required for personnel clearances and learning curve, only to turn around and immediately transition again to another vendor upon completion of the follow-on procurement. The extension would apply to BPA task orders as indicated below: Task Orders DR-33-06-317-TO3, DR-33-06-317-TO44, DR-33-06-317-TO45, DR-33-06-317-TO49, DR-33-06-317-TO54, DR-33-06-317-TO59, DR-33-06-317-TO62, DR-33-06-317-TO65, DR-33-06-317-TO69, DR-33-06-317-TO70, and DR-33-06-317-TO74 will be extended by no more than six (6) months, to December 31, 2013. These task orders provide IT security services to the entire NRC except for the Office of Nuclear Security and Incident Response (NSIR). A competitive follow-on procurement is in progress for these task orders now, and it has taken longer to evaluate the proposals and complete the award process than was originally estimated. Task Orders DR-33-06-317-TO64, DR-33-06-317-TO71, and DR-33-06-317-TO78 will be extended by six (6) months, to December 31, 2013 with an additional six (6) month option that would be exercised only if necessary. These task orders provide IT security services to NSIR. Activities for a competitive follow on task order are underway and additional time is needed to finalize requirements and evaluation factors for award. These services for NSIR are being competed separately from the other task order for the rest of the agency to avoid any potential conflict of interest concerns. As the incumbent, MAR Incorporated is the only source presently capable of providing continuity of these critical services during the "bridge" period. The services provided by MAR Incorporated under the aforementioned BPA are vital to the agency's mission and assists the agency in developing and maintaining its cyber security program. These critical operations support every NRC office. MAR Incorporated has been providing service under this BPA for over 5 years and possesses the in-depth comprehensive institutional knowledge to provide the uninterrupted and seamless transitional support needed until the follow-on competitive award is in place. Continuity of these services is critical to NRC until NRC can complete the competitive follow-on task orders.
