Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (Reference FAR 6.303-2) 1. Identification of Agency: USDA Forest Service, Region 4, Acquisition Services 2. Description of action being approved: Succeeding lease with Mr. Ashley Thompson for the Cascade Ranger Station, Cascade, Idaho for 6,890 RSF of office space. 3. Description of supplies or services required to meet agency's need including estimated value: The lease is for 15 years, 5 years firm with termination rights of not less than 90-days with written notice. The rental rate for the 5-year firm term will be <redact>. The rent will <redact>. per year. The Lessor will incur the cost of blast proof film on all exterior windows ($<redact>). Tax and CPI escalations will occur. 4. Identification of statutory authority permitting other than full and open competition: Statutory authority lies in the FAR at 6.302-1, (2), "...services...are available from only one responsible source...and no other...services will satisfy agency requirements..." and further in the FAR at 6.302-1, (2) (ii), "...award to any other source would result in - (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition...". (41 USC 253 (c) (1). 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: The space still fits the needs of the Ranger District, although the amount of space will be reduced. No other buildings within the city limits are large enough to accommodate the space the District needs. The entire infrastructure is in place, the District will not have to pay to move and there will be no "downtime" of employees. Therefore, remaining in place fits the requirements of the FAR. It is in the public interest to remain. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a CBD notice was publicized: Synopsis and publication for blocks of leased space under 10,000 square feet is not required as prescribed in FAR subpart 5.2. A notice for Sources Sought was posted on FedBizOps on June 7, 2012. There were no responses. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: A market survey was conducted to make the determination that the anticipated cost is fair and reasonable. The Lessor also included with his bid 9 comparable leased public buildings that ranged in price from <redact> per rentable sq. ft. I have determined that the negotiated rate of $<redact>is fair and reasonable. 8. Description of market research conducted: See #7 above. 9. Any other facts supporting the use of other than full and open competition: None 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition: None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: Future acquisition will be fully competed. 12.
