- This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Part 12. This notice constitutes the only solicitation for this requirement and this solicitation is a request for quotation. The U. S. Fish and Wildlife Service has a requirement to furnish, deliver, and tailgate spread gravel, as specified, to the Back Bay National Wildlife Refuge in Virginia Beach, VA. This is a small business set-aside. This document incorporates provisions and clauses updated through Federal Acquisition Circular (FAC) 2005-68, effective June 28, 2013. The NAICS code is 212321 with a small business size standard of 500 employees. The following commercial clauses and provisions apply to this requirement and are in effect through Federal Acquisition Circular (FAC) 25-66. 52.212-1 Instructions to Offerors Commercial Items, 52.212-3 Offeror Representations and Certifications Commercial Items, 52.212-4 Contract Terms and Conditions Commercial Items, 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. Additional FAR Clauses that apply are 52.204-10, 52.211-18, 52.219-28, 52.222-3, 52.222-19, 52.222.21, 52.222-22, 52.222-26, 52.222-37,52.223-6, and 52.223-18. The full text of any solicitation provision or clause referenced herein may be accessed at http://acquisition.gov/far/. REQUIREMENT: Item 1. Furnish and delivery (tailgate spread) approximately 4,850 tons of gravel aggregate materials as specified. Item 2. Additive Item (dependent on availability of funds: Furnish, deliver, and stockpile approximately 65 tons of gravel aggregate material as specified. The delivery sites for the materials are located at the dike road within the Back Bay National Wildlife Refuge (NWR) in Virginia Beach, Virginia. Prospective offerors are encouraged to inspect the site. Contact Greg Owens, Facility Manager at the Back Bay NWR, Virginia Beach, Virginia at 757-416-8959. Delivery shall occur within a two-week window in October 2013(M-F 7:00am-4:00pm, excluding federal holidays). All deliveries shall be coordinated in advance with Greg Owens at 757-416-8959. All work shall be performed in a safe and healthful manner as required by the Construction Safety and Health Regulations promulgated by the Department of Labor's Occupational Safety and Health Administration (OSHA) (29 CFR Part 1926) and any applicable United States Fish and Wildlife Service (USFWS) Safety and Health Regulations. MEASUREMENT AND PAYMENT Basis of Measurement - Unit Price Items: The unit of measurement for the bid items pertaining to gravel materials will be the ton (2000 pounds) for gravel materials weighed on approved scales and recorded on delivery tickets. Measurement will be for the quantity of gravel materials furnished, delivered, and tailgate spread at the designated road and site. Quantities for payment shall be recorded to the nearest 0.1 ton. Payment will be included in the unit price for the materials. Scales must be certified by the State of Virginia Office of Weights and measures. Basis of Payment - Unit Price Items: Gravel Materials will be paid for at the contract unit price per ton of material furnished, delivered, and tailgate spread at the designated roads and sites at the Refuge, which shall be full compensation for furnishing all labor, materials, equipment and incidentals necessary to complete all phases of the delivery and tailgate spreading, all in accordance with these specifications. The tons of gravel delivered shall be recorded on delivery tickets, which shall be countersigned on the date of delivery by the on-site Government representative, in order for payment for materials to be made. SUBMITTALS AND CERTIFICATIONS Submit 5 copies of supplier's certification to Engineer for review. If more than one borrow site is proposed for use, submit certification for each site. Submittals are required for gravel materials, and shall conform to or exceed specified requirements. Submit supporting reference data, affidavits, and recent test data as appropriate. Submit certification that scales used to weigh materials comply with State requirements. ACCESS Roads within the Refuge consist of graveled roads and trails. Every precaution shall be taken by the Contractor to minimize deterioration of the roadways and maintain them passable. Upon completion of the work, roads and trails shall be returned to their condition prior to contract operations. Hauling Restrictions: Load restrictions on Refuge roads are identical to the State load restriction, with such additional regulations as may be imposed by the Refuge Manager. Load weight on Refuge roads is restricted to no greater than 30 tons per load. Contractor shall provide for Refuge, State and other non-owned vehicular traffic to adjacent areas. DAMAGE TO EXISTING FACILITY Prior to final acceptance by Government, the Contractor shall repair or otherwise return to original condition any parts of the existing facilities which have been damaged during delivery of items by the Contractor. The Contractor shall make an inspection of the project area with the Facility Manager prior to the start of work to determine the pre-work condition of the areas. GRAVEL MATERIALS GENERAL Tailgate spread the gravel at a 2" to 3 depth. Under observations of on-site Refuge personnel, begin tailgate spreading the gravel along Dike Road, as directed, until the gravel quantities awarded run out. REFERENCE: Virginia DOT Specifications Section 208 - Aggregates SUBMITTALS (a) Submit certificate from supplier certifying materials for borrow fill gravel and stone meet requirement of these specifications. (b) Submit copy of latest gradation analysis and test data for materials proposed for use. (c) Submit delivery ticket at time of delivery for each load of material delivered to the site showing truck identification and tare weight, and weight of load for gravel materials. PRODUCTS (a) Gravel materials shall consist of crushed stone or gravel. Materials shall be obtained from sources provided by the contractor, and shall be free from loam or other organic matter, trash and debris. (b) Gravel materials shall meet the specification and gradation requirements of Virginia DOT Specifications Section 208 for Size Number 21A type material, with the following gradation requirements: Size No. Percent Passing 2 100 1 94-100 3/8 63-72 No. 10 32-41 No. 40 14-24 No. 200 6-12 EXECUTION (a) Provide proper notification to and coordinate delivery and placement of gravel materials with the Facility Manager. (b) Gravel materials shall be delivered, placed, and tailgate spread at the proposed site at the Refuge facility, at a rate such that a layer of approximately 2 to 3 inches in thickness is placed over the road surfaces. (c) Stockpiling of materials on the Refuge will be permitted only with prior approval of the Facility Manager, and only at approved locations. SOLICITATION/ORDER TERMS AND CONDITIONS Offeror must be registered and active in the System for Award Management (SAM) to be considered for award. See www.sam.gov.
