Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. The Office of Acquisition Management is conducting this acquisition for Three Harris 150 Watt HF Base Station and Three Vehicle Radio System and Accessories on behalf of DS/T/ATA. 2. Nature and/or description of the action being approved are the immediate purchase of the three Harris 150 Watt HF Base Station and Vehicle Radio System and Accessories. This is a one-time procurement for the Harris Radio systems. Due to the encryption requirements there are no other suppliers or competitors identified that can provide a similar system to meet the specifications within this document. 3. A description of the supplies or services required to meet the Department's needs. The requirement is for three 150Watt HF Base Station Radio Systems Mounted in Transportation Cases, Data System Accessories, three 150 Watt HF/Vehicle Radio Systems and Translation and Manuals in French. Please see attached for complete listing of components for each system. 4. An identification of the statutory authority permitting other than full and open competition. 41 USC 253(c) (1), FAR 6.302-1Onlyone responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Due to the Harris radios incorporation of a wireless encryption (mutual Authentication) via Harris proprietary Traffic Flow Security (TFS) Encryption Enhanced Interference Mitigation (EIM) and data smoothing. Other manufacturer's radios will not be interoperable. Harris is the only manufacturer of this radio with no retailers within the United States. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A sources sought was conducted through GSA e-Buy as well as an internet search to determine if any vendors other than Harris Communications could support this effort. The justification and approval documentation will be posted on FBO.gov in accordance with FAR 5.201 for up to 30 days to allow industry the opportunity to review the requirement and respond if they are a potential source that can meet all of the specifications stated and attached. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. All pricing comes under the DoD CECOM contract and a GSA contract, based on a review of those contracts the CO has determined the prices to be fair and reasonable. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. A source sought was completed through GSA Advantage on 3/1/2013 with the following twelve (12) vendors responding with no comment or that they do not support Harris Equipment: Dell Marketing L.P., BAHFED CORP, Component Sourcing Group, Midland Radio Corporation, Progressive Concepts, Network Specialty Group, Inc., BAE Systems Information Solutions, Softchoice Corporation, International Business Machines, Four Points, Telewave, INC., and Mayer Electric Supply Company Inc. 9. Any other facts supporting the use of other than full and open competition. The encryption components ( consisting of built in software, Traffic Flow Security (TFS) Encryption Enhanced and Interference Mitigation (EIM) built within the RF-7800H-MP system makes this radio incompatible with similar radios. An embedded GPS receiver is included in the RF-7800H-MP to display local position and to provide automatic position reporting for situational awareness on the battlefield. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. At this current time, this requirement cannot be competed and the Government is not interested in seeking any additional industry solutions as this will save time and resources for all parties involved. However, should the requirement change and DS/T/ATA mission needs evolve; at that time it may be possible to compete a future solution.
