Description
SOW for RFQ_FEC_13_0000VP This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number for this acquisition is RFQ_FEC_13_0000VP and the solicitation is being issued as a Request for Quote. The FEC Legal Division employee users will be able to continue with their job responsibilities as relates to this government agency. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-69 dated August 1, 2013. This acquisition will be processed under Simplified Acquisition Procedures (SAP). This acquisition is being processed under the authority of FAR 13.5, "Test Program for Certain Commercial Items" and therefore will utilize simplified procedures for soliciting competition, evaluation, and award documentation and notification that comply with FAR 13.1. The RFQ issued under the authority of the FAR 13.5 Test Program are not subject to the procedural formalities contained in Part 15 of this and higher-level regulations. For example, RFQs issued under the test program do not require a source selection plan, evaluation factors, scoring of offers, Competitive Range Determination or formal Source Selection Decision Document. All responsible sources may submit an offer that will be considered by this agency. The North American Industry Classification System Code (NAICS) for this acquisition is 519130 (Internet Publishing and Broadcasting and Web Search Portals) and the small business size standard in number of employees is 500. This is a fixed-price purchase order with a Base Year, plus Four Option Years. FAR provisions and clauses that apply to this acquisition are as follows: FAR 52.212-1, Instructions to Offerors, Commercial Items (July 2013); FAR 52.212-2, Evaluation-Commercial Items (January 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offerors in the order of importance as follows: 1. Technical Capability of the item offered to meet the Government Requirement. 2. Price - the Government may award a contract on the basis of the initial offer received, without discussions. Therefore, the initial offer should contain the offeror's best terms from a cost and price standpoint. Award will be made based on factors other than price alone. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (August 2013); FAR 52.212-4, Contract Terms & Conditions Commercial Items (July 2013); FAR 52.212-5, Contract Terms & Conditions Required to Implement Statutes or Executive Orders- Commercial Items (August 2013); FAR 52.225-1, Buy American Act-Supplies (February 2009); FAR 52.204-7, Central Contractor Registration (July 2013); FAR 32.703-2, Availability of Funds (April 2002); FAR 52.232-34, Payment by Electronic Funds Transfer-Other than Central Contractor Registration (and the System for Award Management registration (https://www.sam.gov) (July 2013). This request for quote is a request for competitive quotations; however, the Government will consider responses submitted. Responses must be submitted no later than 10:00 PM Eastern Standard Time (EST), September 6, 2013 to fecproposals@fec.gov and reference RFQ_FEC_13_0000VP. Electronic submission will ONLY be accepted. All information furnished must contain sufficient detail to allow the government to determine if it can meet the above specifications described herein. Please reference the announcement number on all correspondences. Requests for information concerning this requirement must be submitted in writing and emailed to fecproposals@fec.gov referencing RFQ_FEC_13_0000VP, no exceptions will be accepted. It is the offeror's responsibility to confirm receipt of all quotations and/or questions by the closing date of this announcement via e-mail. Telephone calls will not be accepted.
