Description
This solicitation is being amended to withdraw the small business set-aside. This requirement is now unrestricted and all responsible sources may submit a quote. Vendors that submitted quotes in reference to the original solicitation are not required to resubmit unless they intend to make revisions. New vendors interested in the award are responsible for submitting a detailed description of how they meet all of the requirements outlined in the Salient Characteristics Attachment I. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is being issued as a Request for Quote under the number RFQP02151300023. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66 effective April 1, 2013. This acquisition is being solicited as a 100% small business set aside with a North American Industrial Classification (NAICS) code of 334517, Irradiation Apparatus Manufacturing, with a small business size standard of 500 employees. The contract award will consist of the supply and installation of two (2) X-ray Whole Body Scanning Systems, one (1) each for the following locations: USP Canaan in Waymart, Pennsylvania, and MDC Guaynabo, Puerto Rico. The Whole Body Scanning System (WBSS) will be capable of detecting various weapons/contraband items and will be utilized by the Federal Bureau of Prisons (FBOP) to increase the safety and security within our correctional facilities. Single or multiple awards will be issued as a result of this solicitation and will consist of the delivery/installation of one (1) WBSS per location. All vendor quotes should be inclusive of all costs associated with delivering and installing the equipment at the separate locations. The FBOP currently utilizes the RADPRO SecurPass and intends to purchase the same item or equivalent to satisfy the current need. The salient characteristics of the RADPRO SecurPass are a firm requirement of the FBOP and quotes to provide equivalent type products must demonstrate their ability to meet all of the physical, functional, and performance characteristics outlined in Attachment I. PRICING/AWARD METHODOLOGY: The Government intends to make a firm-fixed price supply award(s) to a quoter, pursuant to an affirmative determination of responsibility, whose quote, conforming to the solicitation, is determined to be in the best interest of the Government considering technical (capability of the item offered to meet the agency need), price, and past performance in accordance with 52.212-1(g). The Government reserves the right to award without discussion; therefore, the initial quote should contain the quoter's best terms from a technical and price standpoint. The Contractor shall be able to provide the items no later than 60 days after date of award. The Contractor shall include all associated charges to the Government for providing the supplies and services required by this solicitation/contract (e.g., equipment, installation, labor, warranties, delivery, etc.). A three-year warranty on parts and labor, to include time and travel associated with the service and maintenance of these systems is also required in the quoted price. The scheduling conference will establish deadlines for oral or written arguments in support of the agency protest and for agency officials to present information in response to the protest issues. The deciding official may hear oral arguments in support of the agency protest at the same time as the scheduling conference, depending on availability of the necessary parties. (f) Oral conferences may take place either by telephone or in person. Other parties may attend at the discretion of the deciding official. The deciding official may request additional information from either the agency or the protestor. The deciding official will resolve the protest through informal presentations or meetings to the maximum extent practicable. (h) An interested party may represent itself or be represented by legal counsel. The Department of Justice will not reimburse the pro- tester for any legal fees related to the agency protest. (i) The Department of Justice will stay award or suspend contract performance in accordance with FAR 33.103(f). The stay or suspension, unless over-ridden, remains in effect until the protest is decided, dismissed, or withdrawn. (j) The deciding official will make a best effort to issue a decision on the protest within twenty (20) days after the filing date. The decision may be oral or written. (k) The Department of Justice may dismiss or stay proceeding on an agency protest if a protest on the same or similar basis is filed with a protest forum outside the Department of Justice. (End of provision) 52.27-103-71 Faith-Based and Community- Based Organizations (AUG 2005) - can submit offers/bids/quotations equally with other organizations for contracts for which they are eligible.
