Description
The National Institute of Standards and Technology (NIST), Acquisition Management Division, on behalf of the Materials Measurement Science Division, intends to enter into a sole source purchase order with Agilent Technologies, Inc. of Santa Clara, CA, under the authority of 41 USC 253(c)(1), only one responsible source for maintenance of an Agilent Technologies 7700x inductively coupled plasma-mass spectrometer (ICP-MS), serial number JP11311205. The period of performance shall be for a one-year base period with four (4) one-year option periods. The Agilent Technologies 7700x inductively coupled plasma-mass spectrometer is located at the NIST campus, 100 Bureau Drive in Gaithersburg, MD. The instrument primarily supports the project Nanoparticle Metrology for Health and the Environment, where it is used to address the environmental, health, and safety of engineered nanoscale particles and to quantitatively characterize nanoparticles developed for biomedical applications such as cancer therapeutics. Sole source determination: While Agilent Technologies maintains a limited number of authorized support providers, Agilent Technologies, Inc. is the sole source for factory-recommended replacement parts, the sole provider of Agilent's proprietary software updates, the sole source for factory recommended upgrades and service notes, and the sole provider of factory authorized training for factory authorized service representatives. Given that the required maintenance agreement includes factory recommended parts, software updates, factory upgrades and factory authorized service representatives, no other source, including a factory authorized service provider can provide the required maintenance agreement. The North American Industry Classification System (NAICS) code for this acquisition is 811219 - Other Electronic and Precision Equipment Repair and Maintenance; the Small Business Size Standard is $19.0M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by September 5, 2013, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
