- Sole Source Justification i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) Solicitation number 13-236-RFQ-00050 applies and is issued as a request for quotation (RFQ). (iii) Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-69. (iv) The North American Industry Classification System (NAICS) code is 541910 and the business size standard is 500 employees. This acquisition is not a small business set-aside. The Indian Health Service intends to award a firm fixed price purchase order on the basis of other than full and open competition (justification attached). (v) The Contract Line Items (CLINs) structure is as shown below. CLIN 0001 - (Base Period - September 15, 2013 - September 14, 2014) - 1 year subscription to the ‘Select Plus' Emergency Care Research Institute Service (vi) The Government intends to negotiate and award an order to ECRI Institute, 5200 Buttler Pike, Plymouth Meeting, PA 19462, for the subscription service that includes the information related to 1) Medical device pre-purchase evaluations & product comparison guides for health technology research and 2) Medical device alert recalls, hazards, product safety issues, problems reported, regulatory analyses, & alerts tracker/management system. (vii) n/a (viii) The provision at FAR 52.212-1 Instructions to Offerors-Commercial Items (Jul 2013), applies to this acquisition and a statement regarding any addenda to the provision. (ix) 52.212-2 Evaluation-Commercial Items (Jan 1999). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: The acceptability of the Technical Quotation and Price will be evaluated. (x) FAR 52.212-3 Offeror Representations and Certifications-Commercial Items (Aug 2013). An offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representations and certificates electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision. (xi) FAR 52.212-4 Contract Terms and Conditions-Commercial Items (Jul 2013) applies to this acquisition. L. 111-117, section 743 of Division D of Pub. L. 111-8, and section 745 of Division D of Pub. L. 110-161). (xiii) 52.252-1, Solicitation Provisions Incorporated by Reference (Feb 1998). This solicitation incorporates one or more solicitation provisions by reference, with the same force as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include block that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer.
