- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Identification Number: Purchase Request 646 - 13- 4 - 3472 - 0157 1. Contracting Activity: VA Pittsburgh Healthcare System Contracting Office (90C-A) 1010 Delafield Road Pittsburgh, Pa. 15215 2.Nature and/or Description of the Action Being Processed: Human Engineering Research Laboratories (HERL) is requesting approval to establish a sole source contract with C-Teck, Inc. We anticipate a firm fixed service contract to provide for personnel, supplies, and expertise needed to repair the Tenney Environmental Chamber used for ISO and ANSl/RESNA Standards testing of power wheelchairs. Total Period of Performance : 1day of service Estimated Total Value - $6,850.00 3.Description of Supplies/Services Required to Meet the Agency's Needs: 4. HER L's Tenney environmental chamber is currently non-operational because of a faulty compressor unit. A new compressor, filters, and refrigerant are needed to get the machine operational once again. The machine is needed for a research study currently underway, so the repairs must be completed no later than 9/15/2013. 5.Statutory Authority Permitting Other than Full and Open Competition: Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1 6.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority This requirement is applicable to FAR Subpart 6.302- 1for the following reasons: the requirement is to obtain supplies or services that are only available from one source. This acquisition allows the VA to obtain supplies and services..... (1)When there is a reasonable basis to conclude that the agency's minimum needs can only be satisfied by- (i)Unique supplies or services available from only one source or only one supplier with unique c apabilities ; HERL's Tenney environmental chamber is quite old and is no longer supported by the manufacture r. C-Teck is a company HERL has used in the past for repairs and yearly calibration of the system, which is required by ISO and ANSl/RESNA Standards. C-Teck is the only company that we have been able to locate that provides services on this model of Tenney environmental chambers. C-Teck has also proven in the past to have the necessary expertise to service the systems, as they are the company that assisted HERL with the move of the machine from Highland Drive to Bakery Square. 7.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:. There are no efforts to make sure that offers are solicited from a s many potential sources as deemed practicable for the following reasons : We attempted to locate other companies that provide service on this old model of Tenney environmental chambers, but C-Teck was the only company that could be found to provide the necessary parts, service, and expertise. 8.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: C-Teck has provided a quote that clearly itemizes the costs into reasonable values. Also, C-Teck has provided expert service on HERL's Tenney environmental chamber in the past and those prices have been deemed fair and reasonable as well. Lastly, C-Teck currently has a remanufactured compressor unit in stock which will significantly reduce repair costs. 9.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No market research was conducted because C-Teck is the only company HERL could find that services this older model of Tenney environmental chambers. 10.Any Other Facts Supporting the Use of Other than Full and Open Competition: HERL has favorable past performance data for this vendor. 11.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No sources have expressed an interest. 12.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required : None-As listed in unique qualifications there are no other Vendors appropriate for this requirement. 13.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
