Description
The National Institute of Standards and Technology (NIST)/Acquisition Management Division on behalf of the NIST/Materials Measurement Laboratory (MML) intends to negotiate on a sole source basis with National Instruments (NI) of Austin, Texas, for software and hardware for the continued construction and operation of three nanoindentation instruments that are in various stages of construction. Included in the purchase are counter/timers, connector blocks, cables, modules, single channel sampling rates, and LabView software. The development of these NIST nanoindentation instruments began in 2007, with the NIST Precision Nanoindentation Platform (PNP). At the inception of this project, a determination was made that commercial software and hardware was needed for the construction and operation of the PNP, and it was determined that LabView software from NI, along with its corresponding data acquisition and instrument control hardware, were the only products that could meet NIST's design goals for the PNP. In 2009, the scope of the PNP project was expanded to include the design and build of two additional PNP instruments that would significantly expand NIST nanoindentation capabilities. These two versions are referred to as the PNP-II and the PNP-III. These versions remain under construction with funding in place for continued support for the next two years. The required NI hardware and software is a follow-on purchase for equipment and software for this ongoing project. PNP-II and PNP-III have many design features and control routines in common with the PNP-I and their functionality is based on NI products purchased in recent years. These NI instrumentation modules can be copied and used across all three PNP platforms which represents a cost savings to the Government. The required hardware is directly linked to the proprietary LabVIEW software modules, and the hardware and software must be purchased together from NI in order for NIST to maintain the ability to build a functioning control system for the PNP-II. Use of another software will result in the failure of the three PNP versions to be compatible with each other and would negatively impact data compatibility among the three instruments. In addition, a redesign of the PNP-II, at an estimated cost to the Government of greater than $500,000.00, would be required. The existing hardware and software are commercial items as are the required equipment. National Instruments has proprietary rights to the existing hardware and software as well as the required hardware and software. National Instruments has no authorized resellers. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by September 12, 2013, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
