- THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR A PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Heart, Lung, and Blood Institute (NHLBI) Office of Acquisition (OA) on behalf of the National Institute of Dental and Craniofacial Research, (NIDCR), intends to negotiate and award a purchase order on a noncompetitive sole source basis to Miltenyi Biotec Inc., 2303 Lindbergh Street, Auburn, CA 95602, to procure one (1) AutoMACS TM Magnetic Separation System. Procurement: The AutoMACS® Pro Separator is a compact, high performance immunomagnetic cell separation instrument with fully automated functions for hands-free operation. 1. AutoMACS® Pro Quantity: One (1); 2. MACS® MiniSampler, Quantity: One (1); 3. MACS® Reagent Pack 4 Quantity: One (1); 4. MACS® Chill Racks (Chill 5, Chill 15, Chill 50), Quantity: Three (3); 5. autoMACS® Columns, 5X2.; 6. autoMACS® Column Substitutes, 2x2; 7. autoMACS® Pro Buffer Combination, Quantity: One (1); 8. Instrument Software, user manual and short instructions BACKGROUND : The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency conducting and supporting medical discoveries that improve people's health and save lives. The NIDCR is elucidating mechanisms of TGF-beta regulation of T-cell immunity and tolerance, and manipulating T-cell immunity versus tolerance in animal models to understand the pathogenesis of autoimmunity and inflammation, cancer and infectious diseases and to develop potential therapies for relevant human diseases, with special attention to NIDCR mission relevant diseases, such as Sjögren's syndrome, periodontal diseases, and oral and head and neck cancers. DELIVERY: Delivery will be made upon award. JUSTIFICATION: Miltenyi Biotec has exclusive rights, US Patent # 5.711.871 and foreign equivalents for the autoMACS machine and MACS reagents including trade secret and proprietary rights. REGULATORY AUTHORITY: This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b) Soliciting from a single source, only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION: Industry Classification (NAICS) Code is 334516, Analytical Laboratory Instrument Manufacturing and the Small Business Size Standard is 500 Employees. The acquisition is being conducted under FAR Part 13, simplified acquisition procedures, therefore the requirements of FAR Part 6 B Competitive Requirements are not applicable (FAR Part 6.001). The resultant Contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-69 (August 1, 2013). This requirement is under the SAT of $150,000.00. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
