Solicitation Number: SPM4A8-13-X-0063 Closing Response Date: September 9, 2013 Point of Contact: L. Ashli Butrico Email: Lauren.Butrico@dla.mil This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a written solicitation will not be issued. This is notice of the Government's intent to issue a sole source purchase order to Testek, Inc (Cage: 06659) under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements and incorporates provisions and clauses in effect through Federal Acquisition Circular 48 CFR 12.603. The agency's minimum needs can only be satisfied by the unique supplies or services available from limited sources, which possess unique capabilities demonstrated as follows: 1. Testek, Inc. is the Original Equipment Manufacturer (OEM) of the 52 Ton Ethylene Glycol Chiller System previously procured under contract SPM4A8-11-C-0035. 2. Testek possesses the unique service capability required to complete the successful installation of the highly specialized equipment and the specialized knowledge to perform informative training. 3. To prevent additional unacceptable delays in fulfilling the agency's requirements this acquisition will be a follow-on contract for continued performance of highly specialized service. The contractor identified above is the only known source that can meet all of the requirements. This is not a "full and open" competitive solicitation and quotes are not being requested from vendors other than Testek Inc. However, the determination to compete, or not compete, this requirement is solely at the discretion of the Government. Description of requirements: On-site start-up and familiarization training on Model 9880-0007, 52 Ton Ethylene Glycol Chiller System. Contract completion is 16 weeks after receipt of order or sooner at no additional cost to the Government. FOB Destination; Inspection and Acceptance at Destination. Service will be completed in Kuwait. Provisions at 52.212-1, Instructions to Offers - Commercial; 52.212-2, Evaluation - Commercial Items; 52.212-3, Offeror Representations and Certifications - Commercial Items be submitted with offer; 52.212-4, Contract Terms and Conditions - Commercial Items; 52.212-5, Contract Terms and Conditions Required to Implement Statutes of Executive Orders - Commercial Items; 52.232-33, Payment by Electronic Funds Transfer - System for Award Management (JUL 2013); 52.246-9061, Warranty of Industrial Plant Equipment (IPE) (FSG 34) (SEPT 2009) DLAD applies to this acquisition. Defense Priorities and Allocations System (DPAS): DOB9 All responsible sources may submit a bid, proposal, or quotation sufficient to determine capability which shall be considered by the agency. Proposals must be submitted to: DLA - Aviation, ATTN: DLA-FASE BID CUSTODIAN, BLDG 33 "B" BAY, 8000 JEFFERSON DAVIS HIGHWAY, RICHMOND, VA 23297-5166 no later than the close of business E.S.T. listed as the closing response date listed. All respondents shall be registered in the System for Award Management, ORCA, and have a valid DUNS number, Cage Code, and Tax Identification Number. All proposals received after the closing date listed may be considered "late" and may not be considered for award. Archiving Policy: Automatic/15 days after response date.
