- Determination for a Brand Name Simplified Acquisition Solicitation #: 192113NFU0000336 Notice Type: Combined Synopsis/Solicitation Synopsis/Solicitation Overview: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is 192113NFU0000336 and is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-69. The associated North American Industrial Classification System (NAICS) code for this procurement is 332994 with a small business classification size of one thousand (1,000) employees. This requirement is a small business set-aside and only qualified offerors may submit a quote. Required Line Items: Item 0001: Two thousand four hundred (2,400) Sig Sauer P239 Caliber Pistol Magazines,.40 caliber, Blue, Product #MAG-239-40-7 (Must be EXACT MATCH), 1, EA. Requirement Description: DHS/ICE is seeking quotes for two thousand four hundred (2,400) Sig Sauer P239 Pistol Magazines,.40 Caliber, Blue. Associated Product # MAG-239-40-7. No alternative product quotes will be considered. Delivery Requirements : Delivery must be made 30 Days after receipt of order (ARO). FOB Destination included in price quotes, which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination Delivery Destination Location: 320 East Chestnut Ave. Altoona, PA 16601 Incorporated FAR Clauses: The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items, no addenda; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.203-15, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-36, 52.222-37, 52.223-18, 52.225-1, 52.225-3 (Alternate II), 52.225-13, 52.232-33. The full text of the referenced FAR clauses may be accessed electronically at https://www.acquisition.gov/far/. Additional Clauses: New Equipment only; No remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. All quotes must be good for 30 calendar days after receipt of quote. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. Registration information can be found at www.sam.gov. No partial shipments are permitted unless specifically authorized at the time of award. The vendor may not substitute any item listed on this order without prior written approval from the DHS/ICE Contracting Officer. No other individual is authorized, either verbally or in writing to change part numbers, manufacturer, quantity, delivery dates, or any other specifications of this RFQ. Items/services that do not conform to descriptions and part numbers found in this RFQ will be rejected at the time of delivery causing a return at the vendor's expense. Brand Name Justification: The Sig Sauer P239 Pistol Magazine (.40 Caliber, Blue), Product #MAG-239-40-7 is the only authorized pistol magazine specifically designed for use in the ICE issued/authorized Sig Sauer P239 Pistols. This product must be original equipment manufacturer (OEM) for function, reliability, warranty, and liability purposes. This product is currently specifically authorized by ICE policy. Please see attached Determinaition for a Brand Name Simplified Acquisition. Evaluation Procedures: An award will be made to the responsive offeror (who submits all required submissions on time), whose past performance does not pose a risk to the Government, and whose offer is the Lowest Price Technically Acceptable (LPTA). An offer is technically acceptable if its technical capabilities conform to the Government's Statement of Work or listed specifications whichever is applicable to the buy.
