PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) and the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NAIMS) intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Beckman Coulter, 250 S. Kraemer Blvd., Brea, CA 92823 for the Biomek 4000. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 532490 with a Size Standard of $30,000,000. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-69, August 1, 2013. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Background Transcription activator-like effector nucleases (TALENs) are emerging technologies that can enhance sequence-specific genome editing efficiency by hundreds to thousands folds. TALENs have been utilized in mouse, rat, human, zebrafish, fruitfly, and plants to generate transgenic lines and knock-in/knock-out models that were not feasible previously be conventional gene targeting technologies. When combined with stem cell technologies, especially induced pluripotent stem cells and embryonic stem cells, TALENs enable us engineer reporter lines and disease models to study human developmental biology and disease mechanisms. While TALENs can target any sequence in the genome, the nature of repeated sequences in TALENs require special modular assembly methods that need to be automated for high-throughput production. Purpose and Objectives The National Institute of Neurological Disorders and Stroke (NINDS) and National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS) awarded FY2013 NINDS/NIAMS Special Initiative to Dr. Rao to purchase equipment and supplies dedicated to produce transcription activator-like effector nuclease (TALEN) for genome engineering in human stem cells. Automated liquid handling machine Biomek 4000 from Beckman Coulter will be used to produce TALEN. Period of Performance The period of performance will be for one year. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the fact that the Biomek 4000 is a versatile bench-top robot that is designed to streamline workflow and automate various laboratory tasks. It has not only preloaded programs designed for routine 96-well PCR setup and plasmid and genomic DNA purifications but also customizable and intuitive user interface to set up complex enzymatic reactions that we need for TALEN assembly. Beckman Coulter is the sole manufacturers of this machine. The parts are unique to these instruments and cannot be substituted by other vendor parts. The engineers from Beckman Coulter have the in-depth knowledge and training to repair these complex machines. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by September 16, 2013 at 3:00pm EST and must reference number NHLBI-CSB-AR-2013-295-KM.
