- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplement with additional information in this notice. This announcement constitutes the ONLY solicitation and no other solicitation document will be issued. This solicitation is issued as a Request for Quote number RFQ HSCG44-13-Q-PC4080. This number is for tracking purposes only. Solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-69. This procurement will be processed in accordance with FAR Parts 12 and 13. The North American Industry Classification System (NAICS) is 335311. The SBA size standard is 750 employees. Due to this Acquisition being considered to be a Sole Source Procurement it is not anticipated that the Contracting Officer will receive two (2) or more Offers from qualified Small Business Concerns; therefore in accordance with FAR 19.502-2(a), This IS NOT A Small Business Set-A-Side. The USCG Command, Control and Communications Engineering Center (C3CEN) Portsmouth, VA 23703, intends to purchase on a non-competitive basis by awarding a Firm Fixed Purchase Order Contract to: RFL Electronics Inc. for the items listed below in the Schedule B. Any Contractor that feels that they can provide the item exactly as stated may provide an FFP Cost Quote in relation to this posting. The proposed contract action resulting from this synopsis/solicitation for commercial items is the Government's intention to solicit and negotiate with only one source under the authority of FAR 6.302.1 and 13.106-1(b). Interested persons/parties may indentify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within five (5) days after date of publication of this synopsis/solicitation will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement, and for informational purposes. The contractor for this proposed Sole Source contract is: RFL Electronics Inc., 353 Powerville Road, Boonton, NJ 07005; Cage Code 0PD85. A current System for Award Management (SAM) Data Search and Business Identification Number Cross Reference System (BINCS) Search was conducted on this Contractor by the Contracting Officer. This Contractor is current/active in SAM and does not have any active Exclusions. Data Search date: 11 September 2013. This is a Sole Source Procurement. See attached JOTFOC Document below. The government intends to award a contract resulting from this solicitation to the responsible bidder proposal conforming to the solicitation which will be most advantageous and Best Value to the Government, price and other factors considered. *PLEASE NOTE* Interested Offeror's are to provide Firm Fixed Price Proposals with Delivery Information by 17 September 2013 @ 7:00AM EST. Delivery Information is to include the Shipping Terms the Offeror is proposing, FOB Origin or FOB Destination. Destination is preferred by USCG/GOV. Also note that paragraph (b) of FAR 52.204-8, applies. JUSTIFICATION FOR OTHER THEN FULL AND OPEN COMPETITION 1. Agency and Contracting Activity: U.S. Coast Guard Command, Control and Communications Engineering Center (C3CEN), CAMS/COMMSTA Product Line, 4000 Coast Guard Blvd, Portsmouth, VA 23703 2. Nature and/or description of the action being approved: This J&A seeks approval to purchase five (5) programmable FSK Transceivers with associated power supplies and chassis. This purchase is required to facilitate the uninterrupted transmission of nationwide weather broadcasts in the event of a circuit outage at either CAMSLANT or CAMSPAC. The broadcast is transmitted from nine (9) remote locations throughout the contiguous 48 states and Hawaii. All broadcast data originates from either CAMSLANT or ACAMSPAC and at present only four (4) of the nine (9) sites can be sourced by both CAMS. A requirement promulgated by CG-6 states that both CAMS will be capable of broadcasting from all nine (9) sites. This purchase is being made up to meet that requirement. 3. Description of supplies or services required to meet the agency's needs (including the estimated value): A necessity exists to procure a total of five (5) FSK transceivers, two (2) chassis with p9wer supplies, and ancillary components. This equipment will be installed at CAMSLANT and CAMSPAC and will provide connectivity to various remote NAVTEX weather information from Bolinas, CA, Astoria, OR and Cambria, CA. It will also provide the means for CAMSPAC to broadcast the NAVTEX weather information from sites in Pungo, VA and Charleston, SC. 4. An Identification of the statutory authority permitting other than Full and Open Competition: 41 U.S.C. 428 (a) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". The RFL Electronics 9850 TX/RX Programmable FSK Transceiver, Part Number: 102050-0-12 with the accompanying ancillary equipment is the only system identified that will meet all requirements and it is only available directly from the manufacturer. 5. A Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. RFL Electronics is the only manufacturer known that produces an FSK transceiver with all of the required specifications. It is conceivable that other systems exist that would be adequate but these systems would not be compatible the existing systems. As two (2) transmitters exist at each of nine (9) sites and each requires two (2) FSK transceivers, a total of thirty-six (36) replacement systems would be required. This in addition to the engineering, design and installation efforts required to convert to a different system. Clearly, it would be cost prohibitive to attempt a complete recapitalization of these systems. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under FAR 5.202 applies: In accordance with FAR 5.201, the intent to purchase these FSK transceiver systems will be advertised in the Electronic Posting System (EPS), Federal Business Opportunities (FBO) as a combined synopsis solicitation under streamlined acquisition procedures for commercial items utilizing FAR Part 12. Any responsible offers will be considered. 7. Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable: The Contracting Officer will determine that the anticipated prices will be fair and reasonable based on purchasing history of previously negotiated procurements. 8. Description of Market Research conducted (see Part 10) and the results or a statement of the reason market research was not conducted: Telephonic and Online research was conducted by the CAMS Product Line. In addition, the FEDLOG interactive search routine was used to determine if the required system was available within the Federal Stock System. These efforts failed to identify any FSK transceivers that met the aforementioned requirements. Further, there were no other distributers of this exact system. Other commercial venders and the federal stock system have similar items but none of these will meet all of the requirements most notably, compatibility with the existing thirty-six (36) systems. 9. Any other facts supporting the use of other than full and open competition: This system is used to provide vital weather information to mariners throughout the entire Atlantic and Pacific seaboards. Without this equipment, an outage at CAMSLANT or CAMSPAC would result in the loss of this vital information to mariners operating in the waters of either coast. 10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition: None at this time. 11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for supplies or services required: None at this time. 12. Contracting Officer's Certification: I certify that this requirement meets the Government's minimum need and that the supporting data, which forms a basis for this justification, is accurate and complete to the best of my knowledge.
