- Justification for Other than Full and Open Competition THIS IS A NOTICE OF INTENT. The Broadcasting Board of Governors (BBG), Office of Contracts (CON) located in Washington, DC, intends to negotiate and award a non-competitive contract to Pinyon Foundation, 1180 South Beverly Drive, Suite 500, Los Angeles, CA 90035, to provide programming related to self-help and self-actualization training for Cuban audiences. The anticipated period of performance is one year from date of award. The statutory authority permitting other than full and open competition that is applicable to this procurement is 41 U.S.C. 253(c)(1) which is implemented at FAR, Subpart 6.302-1(i) (A) which permits other than full and open competition when the “supplies or services may be considered to be available from only one source if the source has submitted an unsolicited proposal that demonstrates a unique and innovative concept.” The nature of the proposed acquisition requires the use of the above cited authority because the highly unique unsolicited proposal submitted by the Contractor provides the capability to empower Cubans through the production of programming related to self-help and self-actualization training. The unsolicited proposal is the product of original thinking that contains new, novel, or changed concepts, approaches, or methods; that has not submitted previously by another; and is not otherwise available within the Federal Government. The Contractor has extensive experience in this area and is uniquely qualified to deliver the aforementioned programming. This Notice of Intent is not a request for competitive price proposals. Interested firms must state in specific detail how they would provide the aforementioned programming; submit appropriate documentation describing the number of years noting their demonstrated experience in providing programming for Cuban audiences, including a brief company history and past performance. All interested Offerors must be registered in the System for Award Management (SAM) www.sam.gov. The written response received from interested firms shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information. The written response must be submitted to Myria Carpenter, Contract Specialist, Broadcasting Board of Governors, by Thursday, September 26, 2013 12:00pm EDST via email at mecarpen@bbg.gov. Telephone and faxed responses are NOT acceptable and will NOT be considered. No telephone responses of an interested firm's statements of interest, capabilities, and pertinent experience will be accepted by BBG. Any questions regarding this Notice of Intent shall be in writing and submitted to Myria Carpenter, Contract Specialist, by facsimile at (202) 382-7870 or by e-mail to mecarpen@bbg.gov. Any determination to compete or not to compete this proposed contract is solely within the discretion of the Government. This Public Notice is not an RFP, IFB, or RFQ.
