- (i)THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR A COMMERCIAL ITEM PREPARED IN ACCORDANCE WITH THE FORMAT IN SUBPART 12.6 AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. (II) SOLICITATION NO. 09122013-WG IS ISSUED AS A REQUEST FOR QUOTES (RFQ) UNDER THIS SOLICITATION USING SIMPLIFIED ACQUISITION PROCEDURES IN FAR PART 13. (III) THIS SOLICITATION DOCUMENT AND INCORPORATED PROVISIONS AND CLAUSES ARE THOSE IN EFFECT FROM THE FEDERAL ACQUISITION REGULATIONS 2005-69, DATED SEPTEMBER 3, 2013 IV) THIS IS A TOTAL SMALL-BUSINESS SET ASIDE PROCUREMENT. THE NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEMS (NAICS) CODE FOR THIS ACQUISITION IS 512110 AND THE SMALL BUSINESS SIZE STANDARD IS $29.5M (V). THE BROADCASTING BOARD OF GOVERNORS, INTERNATIONAL BROADCASTING BUREAU (BBG/IBB), OFFICE OF CONTRACTS (CON) LOCATED IN WASHINGTON, D.C. HAS A REQUIREMENT FOR A CONTRACTOR TO PROVIDE INDEPENDENTLY SUPPLY THE INTERNATIONAL BROADCASTING BUREAU (IBB), VOICE OF AMERICA (VOA), WITH PRODUCTION MUSIC.(VI.) THE BROADCASTING BOARD OF GOVERNORS, INTERNATIONAL BROADCASTING BUREAU (BBG/IBB), OFFICE OF CONTRACTS (CON) LOCATED IN WASHINGTON, D.C. HAS A REQUIREMENT FOR A CONTRACTOR TO PROVIDE INDEPENDENTLY SUPPLY THE INTERNATIONAL BROADCASTING BUREAU (IBB), VOICE OF AMERICA (VOA), WITH PRODUCTION MUSIC. THE MUSIC SHALL BE SUPPLIED THROUGH DIGITAL DOWNLOADS. THE CONTRACT SHOULD PROVIDE OVER 1,300 CD'S WORTH OF MATERIAL. THE MATERIAL CAN BE ACTUAL OR VIRTUAL CDS. EACH YEAR THE CONTRACT SHOULD PROVIDE AT LEAST 100 NEW VIRTUAL DISCS. THE MUSIC CAN BE USED BY VOA IN TELEVISION, RADIO OR INTERNET PRODUCTION. DURING THE EFFECTIVE TERM OF THE AGREEMENT (9/30/13-09/29/18), THE VENDOR GRANTS, ASSIGNS, AND TRANSFERS TO VOA A ROYALTY-FREE, NON-EXCLUSIVE SYNCHRONIZATION AND RECORDING LICENSE TO TRANSFER AUDIO TRACKS, BY RECORDING MAGNETICALLY AND/OR DIGITALLY, IN WHOLE OR IN PART, ON AN UNLIMITED BASIS, ANY OF THE AUDIO CONTAINED IN THE PRODUCTION MUSIC LIBRARY, AND TO USE AND BROADCAST SAID AUDIO COMMERCIALLY, NON COMMERCIALLY, NON-THEATRICALLY, WORLDWIDE, EXCLUSIVE OF THE UNITED STATES IN PERPETUITY. THE VENDOR FURTHER AGREES THAT THE IBB HAS THE RIGHT TO DISTRIBUTE AND EXHIBIT WORLDWIDE, IN PERPETUITY, ALL FILMS, VIDEO TAPES, RADIO PROGRAMS AND INTERNET TRANSMISSIONS CONTAINING THE VENDOR'S MUSIC CONTAINED IN THE PRODUCTION MUSIC LIBRARY. (VIII) THE FEDERAL ACQUISITION REGULATION (FAR) PROVISION FAR 52.212-1 INSTRUCTION TO OFFERORS-COMMERCIAL ITEMS, APPLIES TO THIS SOLICITATION. FAR PROVISIONS AND CLAUSES MAY BE OBTAINED FROM THE INTERNET WEB ADDRESS AT: HTTP://ACQUISITION.GOV/FAR/INDEX.HTML. ALL QUOTES SHALL CONTAIN THE INFORMATION DESCRIBED IN THIS SOLICITATION NOTICE. FAILURE TO COMPLY WITH INSTRUCTIONS MAY RESULT IN QUOTE NOT BEING CONSIDERED FOR AWARD. B. NOTE - SAM REPLACED THE CENTRAL CONTRACTOR REGISTRATION (CCR) AND ONLINE REPRESENTATIONS AND CERTIFICATIONS APPLICATIONS (ORCA) WEBSITES. (IX) THE GOVERNMENT WILL AWARD A COMMERCIAL ITEM, FIRM-FIXED-PRICE, PURCHASE ORDER(S) RESULTING FROM THIS RFQ TO THE RESPONSIBLE OFFEROR(S) WHOSE OFFER CONFORMING TO THE RFQ WILL BE MOST ADVANTAGEOUS TO THE GOVERNMENT, BASED ON PRODUCTION QUALITY, RELEVANCE TO OCB'S AUDIENCE, SUBJECT MATTER AND VALUE PROPOSITION. IN ADDITION, PRICE WILL BE EVALUATED TO DETERMINE THAT IT IS FAIR AND REASONABLE.
