Description
JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a Firm-Fixed-Price Delivery Order (DO) under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition (GWAC), for the purchase of MicroStrategy Annual Software Maintenance. 3. Description of the Supplies or Services: The Department of Veterans Affairs (VA), Office of Acquisition & Logistics (OAL), has a requirement to procure the renewal of MicroStrategy Annual Software Maintenance. MicroStrategy is a Business Intelligence (BI) enterprise-reporting, dashboard, and On-Line Analytical Processing (OLAP) software tool in its Electronic Contract Management System (eCMS). The MicroStrategy software tool-set allows reporting and analysis of data stored in a relational database, multi-dimensional database, or flat data file. This software helps understand and make sense of the data collected in order to make more strategic business decisions. The proposed action is to acquire 12 months of MicroStrategy software maintenance support. The software maintenance support will provide VA with the most current release of the application and software patches, along with access to the MicroStrategy technical help desk. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in paragraph eight of this document, similar products will not suffice. VA currently utilizes MicroStrategy software as part of eCMS to generate reports and conduct data analysis. VA currently owns 405 perpetual licenses for the MicroStrategy software. Only MicroStrategy maintenance can be used for MicroStrategy products. Failure to obtain the aforementioned software maintenance support will have a significant negative impact on the ability of OAL's management to monitor and report on VA's procurements. Failure to have these monitoring and reporting capabilities would result in excess dollars being spent, in addition to having a detrimental effect on procurement oversight authorities who depend on this software to provide necessary reports. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. It was determined however that limited competition is viable among authorized resellers for this brand name item. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Similar software and maintenance were reviewed and none would be compatible and interoperable with the existing VA software. Additionally, this is a maintenance contract for existing software VA already purchased. Only MicroStrategy, or an authorized reseller, has the proprietary rights to warranty this software. The Government technical experts determined that no other maintenance could meet the requirements. Market research was conducted by the Government in August 2013 utilizing the NASA SEWP IV Manufacturer Lookup tool and the Product Verification tool to identify potential sources capable of providing MicroStrategy Annual Software Maintenance. A search of NASA SEWP Contract Holders indicated that there are nine (9) resellers of the MicroStrategy Annual Software Maintenance on NASA SEWP IV including one (1) from Group A, Value Added Resellers (VARs) and Computer System Original Equipment Manufacturer (OEM), five (5) from Group B, Service Disabled Veteran-Owned Businesses (SDVOSB) VAR and three (3) from Group C, Small Business VAR. Although there are sufficient number of Group B contract holders who can meet the Government's requirement, recent Request for Quotations (RFQ) with similar requirements issued to only Group B contract holders have resulted in not receiving sufficient number of responses from firms capable of providing the necessary services. As a result, the lack of responses required the Government to re-solicit to Group B and C contract holders. In order to promote competition and ensure this requirement is awarded prior to the end of fiscal year 2013, this procurement will be competed amongst NASA SEWP IV Group B and C contract holders on the NASA SEWP IV GWAC. 9.
