- This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. Solicitation No. A13PS00947 herein cited will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-69. Set aside for Small Business, Buy Indian. Scope of Work Engineer Inspection and Evaluation of Landfill Covers for 33 Landfills Located in Arizona, New Mexico and Utah Introduction: During the 1997, the BIA operated approximately 33 solid waste landfills at various locations throughout the Navajo Indian Reservation to dispose of solid waste generated by BIA agencies and schools. Trenches were excavated and waste was collected and deposited in the trenches (cells). There was no solid waste collection system in place for the local communities so BIA permitted community residents to deposit household waste into the cells. A visual survey conducted in 1991, found that the waste included both school waste (books, papers, boxes, institutional-sized food cans, kitchen food waste) and residential waste (household appliances, old clothes, furniture, food waste and other miscellaneous house hold items). History: In 1991, a notice was sent to all BIA agencies and schools alerting operators of the landfills of proposed changes to the existing Code of Federal Regulations (40 CFR 247) which would change the regulation substantially and the existing system could no longer continue to operate it method for receipt of solid waste. The new 40 CFR 258 regulations provided definitions for the type of solid waste that could be deposited, daily cover requirements, groundwater monitoring and final cover design changes. It also allowed the landfill operators to close their sites as an alternative compliance method. BIA chose to close most of its landfills. In 1997, the 40 CFR 258 regulations were enacted which included regulations for final closure and cover for landfills or to construct and install the new regulatory requirements. BIA chose to administratively close or closed its landfills for operation with a 40 CFR 247 cover. Unfortunately, there were a few isolated locations where residents did not have access to an alternative waste disposal system, so the BIA landfills remained open until an alternative disposal system was developed and then closed a few landfills in accordance to 40 CFR 258.60(a) requirements and later closed the remaining sites in accordance with the Draft Site Specific Flexibility Guidance for Municipal Solid Waste Landfills for Indian Country provided by U.S. Environmental Protection Agency (using alternative covers such as capillary barrier or evaporation transpiration (ET)). A list is attached identifying the type or final cover that was installed at each of the landfills. Scope of Work: The Bureau of Indian Affairs requires the services of a contractor with documented solid waste landfill operations and closure experience who has worked on the Navajo Indian Reservation applying both USEPA and Navajo Nation Environmental Protection Agency Resource Conservation and Recovery Act compliance regulations. The contractor must have in particular conducted inspections and evaluation of landfill covers in accordance with the mandatory 30-year monitoring requirements of both 40 CFR 247 and 40 CFR 258. The contractor shall travel to each of the 33 locations and inspect each landfill to determine the integrity of the final cover. The contractor will photograph the location, GPS the landfill boundaries, identify the number of cells at each location and test the existing cover for verification of the final cover depth by hand auger or other acceptable means of measuring the landfill cover depth in accordance with the regulatory standards. Award will be made to the lowest priced offeror, who's quote conforming to the requirements herein, will be most advantageous to the Government, and is fair and reasonable. This will be a Fixed Price Contract with Economic Price Adjustments. According to the Buy Indian Act, companies claiming Buy Indian, must submit a signed self-certification form to be submitted with their response to this solicitation.
