- The Federal Bureau of Prisons (BOP) intends to award a sole source contract action to Messaging Architects, Inc. of Montreal, Canada, for the renewal of annual maintenance and support services for NetMail Archive 1-year Subscription annual maintenance, software support/maintenance, annual Assureon Support. The BOP's Messaging Architect Groupwise Archive System provides the current back up, archive and retrieval system for the BOP's online e-mail system. The existing Messaging Architect Groupwise Archive System is a unique system that is not duplicated in any other product already in place. This is a, sole source, combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 and FAR 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and the Government does not intend to issue a written solicitation. The solicitation is being issued as a Request for Quote (RFQ) RFQ-NAS-0019-2014. The Provisions and Clauses incorporated are those in effect through Federal Acquisition Circular 2005-69. The North American Industrial Classification (NAICS) code is 511210 which has a size standard of $25.0 million. The performance period will be 10/1/2013 through 9/30/2014. The requirement is for the following: 1) NetMail Archive 1-Year Subscription 2) NetMail Support 30 Minute Response time 7x24, up to 6 on-site visits per year; 24x7 Access; Quarterly review of current system with report of current status and recommendations 3) SoftWare Support/Maintenance GWG02052009-1B 4) NBD-GX2-G1F42: NBD-GX2-G1F42750 Annual Assureon Support CONTRACT CLAUSES: ADDENDUM TO FAR 52.212-4, Contract Terms and Conditions-Commercial Items (FEB 2012) The terms and conditions for the following clauses are hereby incorporated into this solicitation and resulting contract as an addendum to FAR Clause 52.212-4 (JUL 2013). 52.252-2, Clauses Incorporated by Reference (FEB 1998) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. The contractor's performance will be evaluated in accordance with FAR 42.15. Contract monitoring reports will be prepared by the Contracting Officer's Technical Representative (COTR) or Contract Monitor (CM) and maintained in the contract file. In accordance with FAR 42.1502 and 42.1503, agencies shall prepare an evaluation of contractor performance and submit it to the Past Performance Information Retrieval System (PPIRS). The BOP utilizes the Department of Defense (DOD) web-based Contractor Performance Assessment Reporting System (CPARS) to provide contractor performance evaluations. The contractor shall provide and maintain a current e-mail address throughout the life of the contract. The contractor will receive an e-mail from the Focal Point thru the following website address webptsmh@navy.milwhen the contract is registered in CPARS. The e-mail will contain a "user ID" and temporary password to register in the CPARS system. The contractor must be registered to access and review its evaluation and/or provide a response. If assistance is required when registering, please contact the Contracting Staff/Focal Point. (End of Clause) Information Technology Security DOJ Order 2640.2F (Nov 2008) Department of Justice (DOJ) Order 2640.2F prohibits the use of non-U.S. citizens in the performance of this contract or commitment for any position that involves access to or assisting in the development, operation, management, or maintenance of any DOJ Information Technology System. By signing this contract or by beginning performance, the contractor agrees to this restriction. (End of Clause) DOJ Contractor Residency Requirement (Jun 2004) For three of the five years immediately prior to submission of an offer/bid/quote, or prior to performance under a contract or commitment, individuals or contractor employees providing services must have: 1. legally resided in the United States (U.S.); 2. worked for the U.S. overseas in a Federal or military capacity; or 3. been a dependent of a Federal or military employee serving overseas. (End of Clause) Providing Accelerated Payment to Small Business Subcontractors (Deviation) (Aug 2012) (a) Upon receipt of accelerated payments from the Government, the contractor is required to make accelerated payments to small business subcontractors to the maximum extent practicable after receipt of a proper invoice and all proper documentation from the small business subcontractor. (b) Include the substance of this clause, including this paragraph (b), in all subcontracts with small business concerns. (c) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.
