Description
THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SSSA) on behalf of the National Institute of Mental Health intends to negotiate and award a contract without providing for full and open competition (Including brand-name) to KinetiCor, Inc., 4471 Kahala Avenue, Honolulu, Hawaii, 96816 for the purchase of KenetiCor Magnetic Resonance Imaging Prospective Motion Compensation System. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334510 with a Size Standard of 500 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-69, September 3, 2013. This acquisition is conducted under the procedures as prescribed in FAR subpart 13.5-Test Program for Certain Commercial Items and FAR subpart 12-Acquisition of Commercial Items at an amount exceeding the simplified acquisition threshold ($150,000) and not exceeding $6.5 million. STATUTORY AUTHORITY This acquisition is for a commercial item or service and is conducted under the authority of the FAR Subpart 13.5-Test Program for Certain Commercial Items, section 4202 of the Clinger-Cohen Act of 1966) and the statutory authority of FAR 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1). DESCRIPTION OF REQUIREMENT This requirement is for the purchase of 1 each KenetiCor Magnetic Resonance Imaging Prospective Motion Compensation System, for product number 3T-Skyr/VD13, that includes: (1) Cross Calibration Software, part no. CC-SW; (2) Low profile system camera and lighting unit, part no. CLU; (3) Systems Instrument Electronics, part no. SIE; (4) Package of three (3) tracking markets and one (1) calibration marker, part no. MKR; (5) Calibration Phantom, part no. PHIM; (6) Frieburg Software Components, part no. FREI; (7) On-site installation and training, part no. OSI; (8) 1year warranty, part no. WAR-1YR; and (9) Technical Support (1-year for motion tracking system hardware/software and 2-years for X-PACE, part no. SUP-1YR. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION This requirement is for the purchase of a Magnetic Resonance Imaging (MRI) Motion Correction Software developed by KinetiCor, Inc. The National Institute of Mental Health, Division of Intramural Research Programs will use the Motion Correction software in its functional MRI Core Facility as it conduct research to further the understanding of healthy and diseased brain function and physiology. The features of KinetiCor's Motion Correction Systems that are essential to the government's requirement are (1) the capability to measure patient motion in 3-dimensions at hundreds of times per second; (2) the capability to allow the scanner self-adjust to compensate for patient motion before recording data or prospective motion correction; and (3) the capability to transmit data to multiple manufactures MRI Scanners. The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on September 3, 2013, synopsis number HHSN-NIH-NIDS-SS-3034528, title ‘MRI Motion Correction Software'. KinetiCor, Inc. was the only response received in response to the sources sought notice for purchase of KenetiCor Magnetic Resonance Imaging Prospective Motion Compensation System. The KenetiCor Magnetic Resonance Imaging Prospective Motion Compensation System meets all of the features essential to the government's needs. This requirement is for the purchase of a Magnetic Resonance Imaging (MRI) Motion CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by September 24, 2013, 12:00 noon eastern standard time and must reference number HHSN-NIH-NIDA-SSSA-3146826.
