Description

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: The proposed sole source action is for a one-year firm-fixed price (FFP) effort for Veterans Integrated Service Network (VISN) 4, Mental Illness Research Education and Clinical Center for Behavioral Health Lab (BHL) software maintenance and technical support with Capital Solution Design (CSD), LLC, 2922 Rogers Drive, Falls Church, Virginia 22042. 3. Description of Supplies or Services: The BHL Software program provides support for delivering evidence based and measurement based mental health care with a focus on supporting integrated primary care/behavioral health care. The BHL Software provides clinical program informatics support that allow for patient tracking, assessment, automated decision making, and monitoring. Under this effort, the Contractor shall provide maintenance and technical support for each BHL software installation site to ensure the BHL software remains operational. This shall include troubleshooting and software defect fixes for the BHL software application and related databases. Technical support shall be handled through a Help Desk service that will operate 9:00AM - 5:00PM Eastern Standard Time. The Contractor shall provide defect fixes for the BHL software to all installation sites. The Contractor shall provide technical support for site audit, site inspection, backup and security issues. The period of performance is 12 months from date of award. 4. Statutory Authority: The statutory authority permitting other than full and open competition is 41 U.S.C.3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5. Rationale Supporting Use of Authority Cited Above: CSD is the only source for continued software maintenance and technical support for BHL Software. Only BHL software maintenance and technical support can be used for BHL products. BHL is the only source capable of providing the support necessary for the software to function properly and securely. Continued software maintenance and technical support are required to allow the system to grow and adapt to patient care needs and technical requirements from VA. Additionally, there is no other software that can replace this product. The software is unique in that it provides a comprehensive approach to integrated care. Even if commercial software was found in the marketplace that could replace BHL software, the potential cost savings gained through competition would not be economical compared to the cost of maintaining and upgrading the current software, versus purchasing completely new software for all VA sites. New software would also likely require similar maintenance, upgrades and technical support. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. Additionally, the proposed action will be synopsized on the Federal Business Opportunities Page in accordance with FAR 5.201. Any proposals that are received shall be evaluated. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: There is no readily available substitute for this product. Internet searches on Behavioral Health software and phone contacts with software users at the University of Pennsylvania and a knowledgeable BHL user at Louisville, Kentucky did not reveal any know contractor who can provide the required software. Since this is a custom product, users have indicated that there is no other software product that meets VA's needs. The Government performed additional Market Research in July 2013. CSD confirmed that the BHL software source code is solely owned by CSD. CSD is the only responsible source that can provide support and maintenance of the BHL software and no other representatives outside CSD is granted access to BHL source code. 9. Other Facts: None
