- PART III - STATEMENT OF WORK 3GENERAL: 3.1Services: Under the authority of 38 U.S.C. Section 8153, Federal Acquisition Regulations Part 13 and Veterans Affairs Acquisition Regulation (VAAR) Part 873 Contractor shall provide a Neurophysiologic Monitoring Specialist to provide Intraoperative Neurophysiologic Monitoring (IONM) services for broad classes of surgical procedures in which neural structures are at risk at the Veterans Affairs (VA) San Francisco Medical Center in accordance with the terms, conditions and prices contained herein. 3.2Pricing: This is an indefinite delivery, indefinite quantity contract where the exact quantities of required service are unknown. 3.3The parties agree that the above pricing is an estimate based on the cost and pricing data available at the time this contract is executed. Prior to the beginning of each option period Contractor may submit data to address any cost increases or cost decreases and the Government agrees to review submitted changes and if justified modify the Agreement to incorporate these changes upon verification of cost. 3.4Contractor Personnel: 3.4.1 Contractor will provide on an as-needed basis a Neurophysiologic Monitoring Specialist to monitor peripheral and central nervous system function for broad classes of surgical procedures including neurosurgery, otolaryngology and orthopedic surgery cases in which neural structures are at risk. 3.4.2 The Contractor shall assign to this contract the following key personnel: [name] and the Contractor shall make every effort to have these key personnel provide the services required herein. 3.4.3 Where key personnel described in paragraph 3.4.2 above are not available to provide required services Contractor shall provide a qualified replacement to provide required services. The Government reserves the right to reject any Contractor personnel and refuse them permission to provide services. 3.4.4 Contract costs shall include salaries, fringe benefits, vacation pay, holiday pay, and professional liability insurance expenses. 3.5Contractor Personnel Qualifications: 3.5.1 Contractor personnel shall have training and education in a related medical field e.g., nursing or electro diagnostic technology, and have specific training in IONM, including electro diagnostics, operating room protocol, sterile technique, surgical procedures, and communications. 3.5.2 Contractor personnel performing under this contract shall meet or exceed recognized National Standards as established by the Joint Commission for Accreditation of Healthcare Organization (JCAHO) and shall be either board-certified or board-eligible in intraoperative neurophysiologic monitoring and have a minimum of two years' experience in recording and interpreting human neurophysiologic signals (ABR, EEG, EP, and EMG). 3.5.3 Contractor personnel shall perform services in accordance with ethical, professional, and technical standards of the healthcare industry consistent with VA policy, regulations. procedures and protocol. Contractor Personnel shall be technically proficient in the skills necessary to fulfill the requirements stated herein including the ability to understand, speak, read and write the English language. 3.5.4 Prior to providing any services under this contract all Contractor personnel must receive and acknowledge receipt (as outlined in paragraph 4) of, Veterans Health Care Administration (VHA) Handbook 1 660.3, Conflict of Interest Aspects of Contracting for Scarce Medical Specialist Services, Enhanced Use Leases, Health Care Resources Sharing. Fee Basis and Intergovernmental personnel Act Agreements (113AS), dated July 24, 2002. 3.5.5 The qualifications of Contractor personnel shall be subject to review by the Chief of Staff and approval of the Director, VA San Francisco Medical Center. 3.6Contractor Personnel Duties and Scope of Work 3.6.1 Contractor personnel shall be under the direction of the Chief, Surgical Service or designee. 3.6.2 Contractor personnel shall by virtue of training and experience is able to perform all levels of Intraoperative neurophysiologic monitoring (IONM) services for broad classes of neurosurgical, otolaryngology, and orthopedic surgery procedures including but not limited to: a.Providing preoperative consultation with surgeons and anesthesiologists, apply needle and surface electrodes over specific peripheral nerves, scalp and specific muscles. b.Contractor personnel shall provide and set up equipment to record EEG, ABR, evoked potentials (EP), including motor and somato-sensory and intraoperative nerve stimulation, and/or EMG activity, identify and correct technical problems, obtain baseline recordings, generate patient reports, control of stimulation, and recording parameters. c.Identification of artifacts which may contaminate the data and/or give false indications. d.Provide real-time interpretation of findings, and providing immediate feedback to surgeons regarding significant changes in activity or identification of specific nerves or neural structures activated by stimulation. e.Provide other standard duties as required. 3.6.3 Contractor personnel shall perform administrative services, which include, but are not limited, to the following: (a)Completion of required clinical and medical record documentation including the use of computerized patient record systems where applicable. Participate in service quality improvement meetings as required. (b)Attend service staff meetings and perform other administrative tasks as required. Maintain work area in a safe and orderly manner and perform other related activities and special assignments as required. 3.7 DOCUMENTATION: The Contractor shall provide document services in accordance with VA policy and procedures. All imaging reports shall be dictated into the existing radiology dictation system or into an approved voice recognition system. The Contractor shall utilize the hospital computer systems, VISTA and CPRS for patient documentation, as implemented. The Contractor shall maintain patient information and medical records, including test results, and follow appropriate procedures to ensure that patient confidentiality rights are not abridged in accordance with applicable state and federal confidentiality laws. 3.8 ORGANIZATIONAL RELATIONSHIP: The Contractor shall work under the direction of the Chief, Surgical Services or designee. Routine work shall be performed with a minimum of supervision; the Contractor will be required to perform duties on his own initiative. Contractor shall act in a thoroughly professional manner at all times. The Contractor shall work in harmony with other members of the professional and technical staff in keeping with established patterns of professional interaction. Tact and courtesy are mandatory when interacting with patients and staff. 3.9 UNIFORMS: The Contractor shall provide uniforms for all contractor employees. Contractor shall wear special protective clothing when required and supplied by the SFVAMC. These items shall remain the property of the SFVAMC. Contractor shall maintain a neat personal appearance and maintain a professional decorum. 3.10 EQUIPMENT/SUPPLIES/FORMS: Contractor shall have the use of all required equipment, supplies and forms for performing services required by this contract. 3.11 QUALIFICATIONS: Contractor employee(s) assigned by the Contractor to perform the services covered by this contract shall be licensed in a State, Territory, or Commonwealth of the United States or the District of Columbia. They must have two (2) to three (3) years minimum experience in recording and interpreting human neurophysiologic signals (ABR, EEG, EP, and EMG). 3.12 WORK HOURS: Contractor's normal regular hours shall be from 8:00 AM to 5:00 PM, Monday thru Friday. However, these services may be required and the contractor shall provide services anytime, 24 hours a day, 7 days a week, as needed; provided that Contractor shall not be required to work more than 10 hours in a single day or 40 hours in a single week (excluding on-call hours). 3.13 MONITORING PROCEDURES: The established productivity standards used for all SFVAMC physicians/clinicians will be used to monitor the Contractor employee(s). Quality Assurance (QA) will be monitored in accordance with Information Letter 10-2001-004 dated March 3, 2001, a copy of which shall be maintained in the office of the SFVAMC. Contractor physician will be monitored for clinical care and patient outcome against the SFVAMC quality assurance program. Monitoring results will be reported through QA process and ultimately to the Director, VA San Francisco Health Care System. Hours worked shall be recorded through: 1) time and attendance logs, 2) daily operating room schedules or log books, 3) weekly and monthly night call schedules, 4) minutes of staff, quality assurance, administrative and educational meetings, 5) sign-in sheets for in-service training sessions, and 6) sign-in sheets for lectures given and attended. The SFVAMC Chief of Staff (or designee) will monitor these procedures. 3A4 EMERGENCY HEALTH SERVICES SFVAMC will render emergency health services for an incapacitating injury or otherwise serious illness occurring while on duty. The Contractor will reimburse for all services provided by the SFVAMC. The Contractor will furnish the SFVAMC with the necessary injury/illness form(s) for reporting purposes. The SFVAMC for statistical and/or billing purposes will retain a copy of the complete form(s). 3.15 PERSONNEL POLICY: The Contractor shall be responsible for protecting the personnel furnishing services under this contract. The Contractor shall provide the following: I. Workers Compensation 2.Professional liability insurance 3.Income tax withholding, 4.Social Security payments The Contractor shall verify and document that all employees who provide patient care services at the SFVAMC have the following before they provide any service related to this contract: 1.History and Physical, 2.Either has received the Hepatitis B vaccine series, or are immune as a result of acquired infection, or have been offered and refused the vaccinations. 3.Received measles-mumps-rubella (MMR) vaccine. (Combined vaccine (MMR) is the vaccine of choice if individuals are likely to be susceptible to more than one of the three diseases and is required for all persons born after1956. 4.A negative PPD within the last year, or, if a known reactor, a negative chest X-ray within the past year. 5.A history of varicella (chicken pox) or, if unknown, results of a varicella antibody test. If non-immune, must be vaccinated with Varivax (Chicken pox). 6.Received training in Universal Precautions and Blood Borne Pathogens, Hazardous Material Management, and Life Safety Management (fire preparedness). 7.Successfully completed cardiopulmonary resuscitation (BLS) training. 3.16 IDENTIFICATION, PARKING, SMOKING, AND VA REGULATIONS: The Contractor shall wear visible identification, provided by the SFVAMC, at all times while on the SFVAMC premises. It is the responsibility of the Contractor employees to park in the appropriate designated parking areas. Information on parking is available from the SFVAMC Police Section. The SFVAMC will not invalidate or make reimbursement for parking violations of the Contractor under any conditions. Smoking is prohibited inside any buildings at the SFVAMC. Possession of weapons, illegal drugs or alcohol is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court. 3.17 COMPLIANCE WITH REGULATORY AGENCIES: Contractor shall assure compliance with all relevant regulatory agencies and standards for their personnel, including but not limited to the Joint Commission on the Accreditation of Healthcare Organizations (JCAHO), and the Occupational Safety and Health Administration (OSHA), for all services rendered under this contract. 3.18 RESPONSIBILITY: The Government may evaluate the quality of professional and administrative services provided, but retain no control over the medical, professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). 3.19 RECORDS: All records will remain the property of the SFVAMC under their exclusive control. Control and jurisdiction of the patient shall remain with the SFVAMC. Contractor employee will have access to private VA patient records to perform services under this contract. Documentation as necessary to any/all patient records will occur within the time frames established by JCAHO. 3.20 DESIGNATION OF THE CONTRACTING OFFICER'S TECHNICAL REPRESENTATIVE (COTR): A technical representative of the Contracting Officer (COTR) will be designated to represent the Contracting Officer in furnishing technical guidance and advice under this contract. The foregoing is not to be construed as authorization to interpret or furnish advice and information to the San Francisco VA Hospital relative to the financial or legal aspects of the contract. Those matters are the responsibility of the Contracting Officer and shall not be delegated. 3.21 RESPONSIBILITY: The Government may evaluate the quality of services provided, but retains no control over the professional aspects of services rendered (e.g. professional judgments). 3.22 WORK HOURS: 3.22.1 Hours of service or call availability are 7 days per week, 24 hours per day and 52 weeks per year. The hours of service or on-call availability are subject to the schedule agreed to by contractor under Section 3.12. 3.22.2 Contractor physician shall be present at the VA facility and shall be actually performing the required services during the core hours. Contractor shall not be paid for "availability" or "on-call" or "standby" services that are not performed at the VA. In the event the contractor does not work a full month, either at the beginning of the term or at the end of the term respectively, the monthly fee shall be prorated on a daily basis to the number of days the contractor actually worked during that month divided by the number of days in that month. 3.22.3 The ten (10) national holidays observed by the Federal Government are: New Year's Day. Presidents' Day. Martin Luther King's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving. Christmas, and any other day specifically declared by the President of the United States to be a national holiday. The Contractor is not required to work on national holidays except for rotational on-call duties. 3.22.4 Payment for any holiday and leave, including sick leave or vacation time, is the responsibility of the Contractor. The Contractor will be required to take call on some national holidays and will be on a rotation schedule with other staff on some national holidays. Contractor is NOT entitled to any paid vacation time. 3.22.5 The Parties agree that the Contractor shall not be considered a VA employee for any purpose. 3.23 UNIVERSAL PRECAUTIONS: By signing this contract, Contractor certifies that all employees assigned to work at the VA are current in Universal Precautions and are aware of pertinent OSHA and Universal Precautions Regulations. 3.24 LIABILITY Applicable federal laws, rules and regulations shall govern liability for damages resulting from the official conduct of the Contractor providing services under this contract. Such damages might include, but are not limited to loss of equipment or property. Tort Claims against the government under this contract shall be filed in accordance with the Federal Tort Claims Act, 28 U.S.C. 2671-2680. 3.25 CONTRACTOR PERSONNEL SECURITY REQUIREMENTS: a. All contractor employees who require access to the Department of Veterans Affairs' computer systems shall be the subject of a background investigation. If the investigation is not completed prior to the start date of the contract, the contractor will be responsible for the actions of those individuals they provide to perform work for VA. i.Position Sensitivity - The position sensitivity has been designated as Low Risk/Low Sensitivity. ii.Background Investigation - The level of background investigation commensurate with the required level of access is National Agency Check with Written Inquiries (NACI).
