PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute for Biomedical Imaging and Bioengineering (NIBIB) intends to negotiate and award a purhcaseorder without providing for full and open competition (Including brand-name) to Agilent Technologies, Inc1400 Fountaingrove Parkway, Santa Rosa, CA 95403 for an inductively-coupled plasma (ICP) analyzer for trace metals. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334515 with a Size Standard of 500 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-69. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Background - The Trans-NIH Biomedical Engineering and Physical Science (BEPS) Shared Resource supports NIH intramural scientists through the development and application of advanced technologies for basic and clinical research. BEPS requires a sensitive, inductively-couple-plasma optical-emission spectroscopy (ICP-OES) analyzer to quantify trace metals in specimens, such as excised cancerous tissues. This is needed to evaluate the effectiveness of the delivery of diagnostic and therapeutic metal-containing molecules and nano-materials to the tissues, in order to develop more effective methods. Purpose and Objectives The Biomedical Engineering and Physical Shared (BEPS) Resource provides collaborative scientific support to scientists throughout the NIH IRP. To further this work BEPS requires an inductively-coupled plasma (ICP) analyzer to detect trace metals in materials and specimens, and in particular in nano-materials where sample volumes are very small and some metals are present in very low concentrations. Therefore, the highest possible sensitivity (lowest detection limit) for trace metals is required. Period of Performance Delivery within 30 days of date of award. Project Description The NIBIB has a requirement for a new Agilent 720 ICP analyzer. General Specifications: • ICP axial viewed optical emission spectroscopy (OES) • mass flow control (MFC) nebulizer gas • 5 channel pump • true simultaneous measurement of analytes with full wavelength coverage • concentric glass nebulizer • nitrogen purge pump • water chiller • autosampler with metal-free liquid flow path • software providing fitted background correction, the ability to monitor results at two or more wavelengths for each element, ability to measure the full Echelle spectrum in less than 1 second Specific Requirements: • axial only ICP design (i.e., not dual axial-radial) • sealed CCD detector with 1 million pixels • detector able to read over 30,000 wavelengths • simultaneous (rather than sequential) measurements of all wavelengths in one exposure • no moving optical parts with one focal plane, one grating, one cross-dispersing CaF prsim • cooled cone plasma interface with argon counter flow that does not require shear gases • fast warm up (achieves detection limit performance within 10 minutes) • continuous wavelength coverage from at least 167 nm to 785 nm • analytical linearity of at least 5-6 orders of magnitude (without requiring the sample to be analyzed twice) and with the ability to use alternate wavelengths that are measured simultaneously • concentric glass nebulizer design • fitted background correction • time resolved data collection, allowing simultaneous analysis of hundreds of wavelengths across the entire spectrum at one point in time • method detection limits (MDLs) of 1 ppb for As, Se, Tl, Pb, and Sb using less than 3 mls of sample Other Important Considerations This is a brand name or equivelant requirement for an Agilent 720 ICP analyzer. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on September 9, 2013. The intended source is Agilent Technologies, Inc., who is the only manufacturer of the Agilent 720 ICP. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
