- 1. Contracting activity: This Limited Source Justification supports a procurement action to be conducted under the authority of the Multiple Award Schedule Program (FAR 8.401). The procurement action is generated by: Office of Personnel Management Facilities, Security & Contracting Boyers Contract Group 1137 Branchton Road Boyers, PA 16018 2. Nature and/or description of the action being approved: Renewal of inventory of the Compuware software tools products contained in the Compuware software account which supports users of the CIO, Operations Technology Management's Data Center's (DC) IBM Enterprise Servers. These software tools are used to support various projects for the Federal Investigative Services, Retirement & Benefits, Chief Financial Officer, Office of the Director, and other lines of business. 3. Supplies or services required to meet the agency's needs: Renewal of software support maintenance services from Compuware entitles OPM to continue to use the Compuware System software products along with the support and maintenance for various Compuware System software products. Continuing the software maintenance support will ensure the CIO, Operations Technology Management's Data Center (DC) ability to support all OPM customers who are dependent on Compuware System software which are used the basis for various OPM business applications. 4. Authority permitting acquisition using limited sources: This brand name acquisition is made pursuant to the authority of FAR 8.405‐6. Application for brand name descriptions is provided for in FAR 8.405‐6(b)(1): Only one source is capable of responding due to the unique or specialized nature of the work. 4.1. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires the use of the authority cited: The maintenance contract for the Compuware software account will expire on September 30, 2013. New versions of Compuware software products, patches and upgrades are only available from Compuware. Without the renewal of the software products contained within the Compuware software account, the Data Center's information technology staff will not have access to technical support from Compuware in the event of system failure or the necessity for troubleshooting. Licensed maintenance support will not be available including the right to access the Compuware web sites to gain access to new versions of the products or program patches and upgrades. 5. Determination by the contracting officer that the anticipated order will represent the best value: Based on the nature of the requirement, the solicitation will be issued to a single source. Competition will not be sought. In order to determine that the anticipated order will represent the best value, the contracting officer and requesting activity will review previous orders and compare the requirement to similar schedules. If services are anticipated, technical support personnel will review the level of effort and labor mix proposed. Additionally, the vendor will be requested to provide any discounts available beyond the published GSA price. 6. Description of the market research conducted and the results or statement of the reason market research was not conducted: Market research was conducted by the CIO to determine if anyone other than Compuware could supply the support services for its software products. These products are proprietary in nature and the computer source code is not in the public domain. The acquisition of these products was done in previous OPM approved contracting actions. 7. Other facts supporting the justification. None. 8. Statement of actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: This acquisition will be conducted using Compuware's GSA Schedule.
