Master BPA # R13PA80605 TAS = N/A as Master BPA is a zero dollar BPA This J&A is also available at http://www.usbr.gov/mso/aamd/doing-business-acquisitions-noncompetitive.html United States Department of the Interior Class Justification and Approval for Other Than Full and Open Competition and Waiver of Publication Requirments DETERMINATION TO SOLICIT FROM A SINGLE SOURCE Solicitation No.: R13PS80519 Project Name: Data Communication Circuits - Connecting Lower Colorado Regional Office To Reclamation's Wide Area Network _____________________________________________________________________________ Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1), for purchases not exceeding the simplified acquisition threshold (SAT). Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). Agency and Contracting Activity. Bureau of Reclamation, Denver Office, AOG Name and Address of Single Source. Level 3 Communications, LLC, 1025 Eldorado Blvd, Broomfield, CO 80021-8254 Description of Supplies/Services and Estimated Cost. This service provides Reclamation with data communications circuits that connect the LC Regional office to Reclamation's wide area network. This data communication path is critical to allow the office access to the Internet, DOI, and other Bureau IT services as well as internal access to Reclamation and DOI IT services such as electronic mail, critical applications (ETAS, CARMA, IDEAS, REDS, BORDAMS, etc.); file services, etc. Period of Performance: 10/1/2013 to 9/30/2018 Description of Circumstances, including why only one source is reasonably available. This data communications circuit rides a backbone that is owned and operated by the Bureau of Reclamation (BOR) and Western Area Power Administration (WAPA). The agreement negotiated by the LC Regional Office and Level 3 allow this circuit to ride the Level 3 backbone to Denver, CO. These data communications circuits are provided by Level 3 through a right-of-way agreement negotiated by the LC regional office and Level 3. These circuits will remain in place with this vendor. Determination of Fair and Reasonable Cost. IAW FAR 13.106-3 and FAR 8.404 orders placed against Federal Supply Schedules (FSS), (d) Pricing. Supplies offered on the schedule are listed at fixed prices. Services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task (e.g., installation, maintenance, and repair). FFS (GSA) have already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d). Description of Market Research. Reclamation's physical layer network rides the Western Area Power Administration's (WAPA) backbone facilities. Level 3 is the only vendor that WAPA has allowed connectivity to their backbone via the Reclamation and WAPA-owned telecommunications facilities and/or equipment. The original right-of-way agreement was first done with Broadwing and the LC Regional Office. Broadwing was acquired by Level 3.
