- The Department of Veterans Affairs, VISN 21, Network Contracting Office 21, intends to negotiate a sole source contract with Toshiba America Medical to provide annual maintenance and services for Toshiba CT Scanner PM#6525-21863 at the VA Central California Health Care System located at 2615 E. Clinton Ave, Fresno, CA 93703. This procurement is being conducted in accordance with FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c) (1)). Contract is firm fixed price and the NAICS Code is 334517. This Notice of Intent is not a request for competitive proposals. No solicitations documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services, as well as references from other customers who are using these products or service, to the Contracting Officer within three (3) calendar days from the date of publication of this synopsis. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirements. Information must be sent via e-mail only to the Contracting Officer at Rusty.Stevenson@va.gov. Responses received will be evaluated however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no responses are received, the Network Contracting Office NCO 21 will proceed with the sole source negotiation with Toshiba America Medical. ? DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Contracting Activity: Department of Veterans Affairs, NCO 21; 2615 E. Clinton Avenue, Fresno, CA 93703. 2.Nature and/or Description of the Action Being Processed: Justification and approval for Other than Full and Open Competition for Toshiba CT Scan Annual Maintenance Service for the VA Central California Healthcare Facility located at 2615 E. Clinton Avenue, Fresno, California 93703. This request will issued against Toshiba America Medical existing GSA Contract Number V797P-6033(B). 3.Description of Supplies/Services Required to Meet the Agency's Needs: The VA Central California Health Care System has a requirement for Toshiba CT Scan Annual Maintenance. This request will provide the onsite maintenance service for the following equipment: Toshiba CT Scanner PM# 6525-21863. The total amount of this service is $123,825. 4. Statutory Authority Permitting Other than Full and Open Competition: FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c) (1)). In addition, this requirement will be executed against existing GSA Contract V797P-6033(B). 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Toshiba is the only authorized vendor that can perform maintenance and service for the CT scanner. Toshiba is the manufacturer, and the only vendor capable of managing software upgrades as the software is regulated and proprietary and cannot be redistributed legally. Any unauthorized maintenance or modification to the system would have to be at the VA's risk, without any sanction from Toshiba; therefore placing all liability on the VA. Toshiba is the only vendor that can meet statement of work for this specific repair. As stated, the software is regulated and proprietary and cannot be redistributed legally by any other vendor. There is no competition for this repair and must be facilitated by Toshiba. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: None. Toshiba is the only authorized vendor capable of performing maintenance on the critical CT scanner. As stated, the software is regulated and proprietary and cannot be redistributed legally by any other vendor. There is no competition for this repair and must be facilitated by Toshiba. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Pricing is that listed in GSA Contract V797P-6033(B). Pricing has been evaluated and deemed fair and reasonable to the Government through initial competition. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: None. None. Toshiba is the only authorized vendor capable of performing maintenance on the critical CT scanner. As stated, the software is regulated and proprietary and cannot be redistributed legally by any other vendor. There is no competition for this repair and must be facilitated by Toshiba. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: No other factors apply, see stated circumstances in para 5 and 6. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. Toshiba is the only authorized vendor capable of performing maintenance on the critical CT scanner. As stated, the software is regulated and proprietary and cannot be redistributed legally by any other vendor. There is no competition for this repair and must be facilitated by Toshiba. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
