The new dates will be provided on FBO by 9 October 2013. ______________________________________________________________________________ 13 September 2013 THIS IS THE FORMAL PRE-SOLICITATION NOTICE IN ACCORDANCE WITH FAR 5.204 PRE-SOLICITATION NOTICE: THIS IS NOT A FORMAL SOLICITATION [INVITATION FOR BID (IFB)] OR A REQUEST FOR PROPOSAL (RFP). PLEASE DO NOT SUBMIT A PROPOSAL. This Pre-Solicitation Notice is being issued for the purpose of advising potential Offerors of the Government's requirement for a Performance-Based Remediation (PBR) effort at Fairchild Air Force Base, Washington. The subject pre-solicitation notice is to provide information for early planning and does not constitute a commitment, implied or otherwise, that a procurement action will be issued. There is no entitlement to payment by the Government of direct or indirect costs or charges that arise as a result of the provision of this information. Note that official information concerning this pre-solicitation will be provided by the Contracting Officer only. GENERAL INFORMATION: The 772d Enterprise Sourcing Squadron/Environmental Services (772 ESS/PKS) in conjunction with the Air Force Civil Engineer Center (AFCEC), at Joint Base San Antonio-Lackland, TX, is contemplating a performance-based approach to achieve minimum performance objectives and stretch goals and support progress to Site Closeout (SC) at 59 Installation Restoration Program (IRP) sites and 1 Military Munitions Response Program (MMRP) site at Fairchild Air Force Base, Washington. This effort is a validated FY2014 requirement; however, funds are not currently available. The Government reserves the right to cancel this requirement at any time. Should the Air Force determine to proceed with this requirement, it will be processed using FAR Part 15 procedures and will result in a Firm Fixed Price (FFP), "C" type contract. The requirement will be issued as a 100% Small Business Set-Aside. A formal solicitation will be finalized and posted to FedBizOpps (FBO) at a later date. No formal Request for Proposal has been issued to-date. PROJECT NARRATIVE: The 772 ESS/PKS is considering a performance-based approach for SC involving remedial action efforts at Fairchild Air Force Base, Washington. PBR emphasizes results in terms of environmental clean-up for an entire installation (fence-to-fence), or group of installations, in lieu of a study-based approach. The PBR approach looks for technically and cost-effective methods for achieving this clean-up by focusing on achievement of desired objectives without specifying the processes or technologies for obtaining those objectives. The PBR initiative has an overarching goal to implement remedies as necessary to protect human health and the environment that maximizes the number of SCs or advance sites as close to SC as practicable during the Period of Performance (PoP) in a cost effective manner. It is desirable to the Government that Life-Cycle Costs (LCC) be reduced. If SC with no new institutional controls is not obtainable within the PoP of this effort, the Contractor shall outline the Optimization Exit Strategy (OES) that will be implemented to accomplish SC. The awarded contractor shall perform all necessary environmental services, minor construction and engineering activities as required to meet the performance objectives of the Final Performance Work Statement (PWS). All documents related to this effort can be located on FBO. The PoP - if all target options are executed - is estimated at 120 months from date of award. The estimated Rough Order of Magnitude (ROM) anticipated for any resultant contract is between $10M and $15M. This ROM is an estimate range only and is provided only for informational purposes. ENVIRONMENTAL INSURANCE (EI): The Air Force is currently NOT proposing to require Cleanup Cost Cap (CCC) or any other type of Environmental Insurance (EI) for this PBR. ORGANIZATIONAL CONFLICT OF INTEREST (OCI): An organizational conflict of interest may result when factors create an actual or potential conflict of interest on a contract, or where the nature of the work to be performed on the contract creates an actual or potential conflict of interest on a future acquisition. Some restrictions may apply to your firm under the proposed future action. In accordance with the parameters set forth in FAR Subpart 9.5, the Contracting Officer must ensure that there are no conflicting roles that might bias a contractor's judgment and must ensure that an OCI does not give rise to an unfair competitive advantage. Performance of past clean-up related work at Fairchild Air Force Base may have created an OCI concerning this PBR effort. OCIs may exist in the following three ways. a. Unequal access to information - access to non-public information that gives a contractor an unfair competitive advantage. b. Biased ground rules - when a contractor has in some sense set the ground rules for another procurement action creating the potential that the contractor may have tilted the playing field in the new competition (usually toward its own strengths and away from its weaknesses). c. Impaired objectivity - when the contract requires exercise of judgment and the independence of its judgment may be affected (e.g., when the contractor may be required to evaluate its own work in a way that could be adverse to its economic interests). Please keep in mind OCI or potential OCI issues your firm (including all subsidiaries, legacy companies, teaming partners, and subcontractors) may have with respect to the scope of effort at these sites. Note: CH2M HILL Constructors, Inc (CH2M HILL) is currently conducting investigations and/or focused remedial design pilot testing at two Fairchild Air Force Base Environmental Restoration Program sites under USACE contract W91238-06-D-0013. The two sites represent a significant part of the Fairchild Air Force Base PBR. The following documents are anticipated to be delivered in draft form prior to the Final RFP release, however, if they are not delivered on time or do not contain sufficient information, they may present an OCI where CH2M HILL has an unfair advantage by having access to site investigation and recently altered site condition information: i. Technical Memorandum, Fairchild AFB, Site SS-39 Pre-Design Investigations. ii. Technical Memorandum, Fairchild AFB Site SS-39 Injection Summary. iii. Technical Memorandum, Fairchild AFB, Site SD-37 Datagap Investigation and Analysis. If these draft documents are delivered on time, the information will be posted to the RFP key documents site and combined with Air Force comments so all Offerors will have access to the same information and there is no OCI. CH2M HILL is also currently conducting optimization of the Fairchild Air Force Base site LF002 remedy under contract FA4890-06-D-0007-0001. As part of that optimization, CH2M HILL built and operated site Soil Vapor Extraction and In-Situ Chemical Oxidation remedy optimization components. CH2M HILL has all of the actual construction and operational cost data associated with the remedy optimization components. If this information is received, it will be posted to the RFP key documents site. This detailed information will be needed for Fairchild AFB site LF002 Proposed Plan and Record of Decision Amendment preparation, which is a required task of the PBR. If the information is not available, it will have to be re-created by estimating all of the associated parameters and costs, which represents significant additional effort another Offeror will need to consider in their proposal. Unless that information is provided in a format readily available to all Offerors, it represents a potential conflict of interest for CH2M HILL. THIS IS A REQUEST FOR SUBMISSION OF QUESTIONS CONCERNING A DRAFT RFP FOR PLANNING PURPOSES ONLY. THIS REQUEST IS NOT A FINAL SOLICITATION. ****PLEASE DO NOT SUBMIT A PROPOSAL.***** Information regarding the Draft RFP is included in this pre-solicitation notice for the purpose of obtaining industry feedback. Response to the request for questions is strictly voluntary and will not affect any firm's ability to submit an offer if, or when, a Final Solicitation is released. However, we highly encourage you to reply. The request is for planning purposes only and does not constitute a commitment, implied or otherwise, that a procurement action will be issued. There is no entitlement to payment by the Government of direct or indirect costs or charges that arise as a result of the submission of information in response to this notice. The Government shall not be liable for or suffer any consequential damages for any improperly identified proprietary information. Proprietary information will be safeguarded in accordance with the applicable Government regulations. As previously stated, this requirement is to provide a PBR approach for SC involving remedial action efforts at the Fairchild Air Force Base, Washington. The PBR initiative has an overarching goal to implement remedies as necessary to protect human health and the environment that maximizes the number of SCs or advance sites as close to SC as practicable during the PoP in a cost effective manner. It is desirable to the Government that LCC be reduced. If SC with no new institutional controls is not obtainable within the PoP of this effort, the Contractor shall outline the OES that will be implemented to accomplish SC. The Contractor shall perform all necessary activities required to meet the performance objectives identified in the corresponding DRAFT PWS, dated 5 September 2013. The PoP is estimated at 120 months from date of award. 1. Firms will not be reimbursed for proposal costs incurred. 2. Request for Questions: The Government anticipates a Final Solicitation to be released in November 2013. This notification is provided to allow early review of DRAFT RFP documentation for this requirement. Questions concerning the DRAFT RFP are due by 2:00 PM CST on 2 October 2013. Questions/Comments regarding the DRAFT RFP MUST be sent to both: linda.cavazos@us.af.mil and christina.fernandez@us.af.mil. 3. If your firm elects to participate in the proposal process for this requirement and the projects are not funded, you shall not be entitled to submit any claim for bid and/or proposal costs. The Government reserves the right to cancel this requirement at any time. 4. System for Award Management (SAM) is the Official U.S. Government system that consolidated the capabilities of CCR/FedReg, ORCA, and EPLS. Representations and certifications are required to be updated annually as a minimum to keep information current, accurate, and complete. 5. If your firm intends to participate in the site visit, a complete response is required as outlined within the "Site Visit Information" section of this notice. Other than site visit attendee information, no further information is requested at this time. ATTENDANCE AT THIS SITE VISIT IS NOT MANDATORY AND IS AT THE SOLE DISCRETION OF EACH FIRM. THE GOVERNMENT WILL NOT REIMBURSE PARTICIPATING FIRMS FOR SITE VISIT COSTS. SITE VISIT INFORMATION: A site visit is tentatively scheduled for 29 - 30 October 2013 at Fairchild Air Force Base, Washington. It is the Air Force's intention to review general base information, site specific information, provide a walk-around of sites (all sites may not be viewed, but representative sites will be viewed) and invite the EPA to provide their input on the cleanup program and the PBR contract. All information to be presented at the site visit will be provided no later than 24 October 2013 for download. Copies of presentation material will not be provided at the site visit.
