- Description
- This contract action was accomplished using other than competitive procedures because there is only one responsible source due to a unique capability provided, and no other supplies or services will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. On 10 OCT 2013 ACC-APG, Tobyhanna Division awarded a Firm-Fixed Price contract to provide the Test Equipment and related software, Tools, Training, Repair data, and Parts for the AN/PYQ-10 Simple Key Loader (SKL) to provide Tobyhanna Army Depot (TYAD) the resources to develop test and repair capability to the module level. The SKL is a ruggedized, handheld, Personal Digital Assistant Device that is used by the Army, Navy, and Air Force as a key component of the National Security Agency's (NSA's) Electronic Key Management System. The primary function of the SKL is to load a secure electronic key (Top-Secret, Secret, and Confidential) into End- Cryptographic Units to enable secure communications among tactical and strategic service networks. The awardee for this action is Sierra Nevada Corporation (SNC). SNC is the only source that has passed all of the required NSA testing, which is necessary to interface its product with the NSA-developed KOV-21 INFOSEC device. SNC is the only source that can integrate software and hardware and verify operability, using the test procedures that SNC developed and NSA approved. SNC, as the Original Equipment Manufacturer (OEM) of the SKL, has unique expertise and knowledge of repair and testing of the SKL. TYAD needs to acquire this expertise through training, purchasing of identical test equipment and test software, and failure and cost data that can only be provided by the OEM.
