- This is a sources sought notice only. This is not a solicitation announcement. No contract will be awarded as a result of this announcement, and no reimbursement will be made for any costs associated with providing information in response to this announcement or any follow-up requests. The Environmental Protection Agency (EPA) is performing market research to identify contractors that may possess the capabilities to support the Office of Enforcement and Compliance Assurance (OECA) as outlined in the attached draft Statement of Work. A brief description of the work is as follows: The North American Industry Classification System (NAICS) code for this procurement is 541620. The subject requirement provides technical, analytical, and enforcement support for EPA's Office of Enforcement and Compliance Assurance (OECA), Office of Civil Enforcement (OCE). OCE is charged with the development, litigation, and settlement of administrative and civil judicial cases against violators of the environmental laws pursuant to the: Clean Water Act (CWA); Safe Drinking Water Act (SDWA); Marine Protection, Research and Sanctuary Act (MPRSA); Clean Air Act (CAA); the Act to Prevent Pollution from Ships; Resource Conservation and Recovery Act (RCRA); Oil Pollution Act (OPA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Toxic Substance Control Act (TSCA); Federal Facility Compliance Act (FFCA); Emergency Planning and Community Right-to-Know Act (EPCRA); Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); Asbestos Hazard Emergency R esponse Act (AHERA); and Mercury-Containing and Rechargeable Battery Management Act (Battery Act). OCE?s activities are diversely implemented under these authorities and in accordance with federal environmental statutes. Major activities include the following: developing national policy and guidance for technical evaluations, investigations, case development and settlement strategies; developing management controls and data systems for assisting with enforcement of, and monitoring compliance with, all national enforcement initiatives and programs; targeting, developing and implementing compliance assurance activities to monitor and improve compliance of the regulated pollution sources; ensuring effective enforcement of environmental requirements; compliance monitoring, including on-site inspections and investigations of pollution sources; motivating the regulated community to voluntarily discover, disclose and correct violations; developing and implementing, in association with the National Enforcement Training Institute (NETI), enforcement related training and workshops; monitoring and enforcing federal, and federally-authorized, State programs; and providing support to Regions, States, Territories, Indian Tribes, and other regulatory authorities. The resultant contract for the discussed requirement will contain a Limitation of Future Contracting (LOFC) clause, stipulating that: During the life of the contract, and for a period of seven (7) years after the completion of the contract, unless prior written approval is obtained from the cognizant EPA Contracting Officer, the Contractor shall not enter into a contract: (1) with owners or operators of facilities that may be impacted by enforcement and compliance activities performed under a Work Assignment, of the resulting contract, as regulated parties under the Clean Water Act (CWA); Safe Drinking Water Act (SDWA); Marine Protection, Research and Sanctuary Act (MPRSA); Clean Air Act (CAA); Resource Conservation and Recovery Act (RCRA); Oil Pollution Act (OPA); Pollution Prevention Act (PPA); Federal Insecticide, Fungicide and Rodenticide Act (FIFRA); Superfund Reauthorization and Amendments Act (SARA); Toxic Substance Control Act (TSCA); Federal Facility Compliance Act ( FFCA); National Environmental Policy Act (NEPA); Emergency Planning and Right-to-Know Act (EPCRA); Comprehensive Environmental Response, Compensation and Liability Act (CERCLA); Asbestos Hazard Emergency Response Act (AHERA); and Mercury-Containing and Rechargeable Battery Management Act (Battery Act); or (2) to act as a consultant to any such regulated parties that may be impacted by enforcement and compliance activities performed under Work Assignment, of the resulting contract. The proposed acquisition is estimated at approximately 208,000 hours, including all options and optional quantities. The Government anticipates awarding two, five-year, cost-reimbursement type contracts, for 70% and 30% of the total hours, in accordance with FAR Part 15: "Contracting by Negotiation Procedures." Interested parties shall submit a brief capability statement, no more than fifteen (15) pages, demonstrating how they are capable of meeting this requirement. Capability statements should respond to all items requested in this notice. Standard brochures and/or paraphrasing of the Statement of Work will not be considered as a sufficient response to this notice. Feedback and/or evaluation information will not be provided to any firm regarding their individual capability statements. Telephone calls, facsimiles, and/or requests for a solicitation will not be accepted or acknowledged. The capability statement should include the following: (1) Name of business; (2) Contact information (address, telephone, facsimile, e-mail, website address); (3) DUNS number, business size and classification; (4) Technical description of ability to meet the requirement (description should address technical competencies, and organizational experience relative to the key task areas in the draft State ment of Work); (5) The concern?s capacity to manage the anticipated volume of work under this requirement; (6) Discussion of any potentially significant organizational conflicts of interest; (7) General financial and organizational information should be provided with regard to the following items: (a) average number of employees of the concern; (b) average annual receipts based on the last three fiscal years; (c) a description of other current business commitments (i.e. contracts, etc..); and (d) a description of the concern?s accounting system for estimating and accumulating costs under cost reimbursement contracts, and whether or not such system(s) have been audited and/or approved by any Government agency. Businesses shall submit electronic copies of their respective capability statements to Trina Fisher at fisher.trina@epa.gov, no later than November 4, 2013, 4:00 PM EST.
