Description
The U.S. Patent and Trademark Office intends to negotiate and issue a commercial services contract to MSS International, 9159 Fox Fire Way, Highlands Ranch, CO 80129 for FY14 Data Synchronizer services. The objectives of the FY 14 Data Synchronizer is the acquisition, installation, and configuration of data synchronization software, as well as the maintenance and training related to data synchronization activities. Specifically, the Office of the Chief Information Officer (OCIO) requires a complete, turn-key, integrated data synchronization solution to maintain bi-directional synchronization between the legacy Trademark Reporting and Application Monitoring System (TRAM) database, implemented using the Unisys DMS II non relational database management system operating on the Unisys mainframe, and the Trademark Next Generation (TM NG) database, implemented using the Oracle relational database management system operating under Linux. Implementing this objective requires: • The acquisition of data synchronization proprietary software source-code licenses between Unisys DMS II and Oracle databases that can meet the integration requirements of this SOW. • The acquisition of Unisys mainframe COBOL code coverage proprietary software licenses. • The acquisition of Unisys mainframe COBOL pre-compiler proprietary software licenses. • Customization, configuration, and integration of the licensed software into a solution meeting the requirements of the Data Synchronization Detailed Design Requirements document • Modifications to USPTO COBOL and ALGOL program sources as required to meet the integration requirements of this SOW. • Support services including installation, maintenance and training as required to meet the requirements of this SOW. The contract will contain a base year and up to four (4) option years. Period of performance for the base year is approximately 12/1/2013 to 9/30/2014. Market research indicates that MSS International is the only known source for providing the data synchronizer services needed by OCIO. When USPTO originally became a user of Unisys mainframes, there were thousands of Unisys systems installed and dozens of companies providing third party software and services to the market. However, USPTO's market research has revealed that it is estimated that less than 400 Unisys A-Series mainframe sites are still active and half of those are outside of the United States. The market is now too small to support multiple companies that provide software products specifically for the Unisys mainframe market. The only company other than Unisys that is still active in the Unisys A-Series market is MSS International. and only MSS International has the two required component products accompanying the synchronizer, mainframe based pre-compiler, and mainframe based code coverage analyzer. As a result of USPTO's exemption from the Competition in Contracting Act, the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A). The proposed North American Industry Classification System (NAICS) code is 541512 (Computer Systems Design Services), proposed Federal Supply Code (FSC) is D307 (Automated Information System Design and Integration Services, and Small Business Size Standard is $25.5 million. This notice is neither a Request for Proposals nor a solicitation of offers.
