- J & A The knowledge required to conduct the aforementioned evaluation and other tasks is specialized and concerns areas of forensic document examination and handwriting analysis expertise that is well beyond the scope of Defense Counsel's understanding. In this case, only one contractor is capable of meeting the unique skill set required to defend the accused. Market research supports other than full and open competition (sole source) for this requirement. Due to the highly specialized area of expertise and the sensitive nature of a Courts-Martial Trial, a limited amount of individuals are capable of providing the anticipated service. Based on the market research and guidance from the USARAK Legal Team, the vendor is the most qualified and capable source to provide this service. Her handwriting analysis expertise and knowledge of forensic document examination make her the only source capable of providing the accused a proper defense in this Courts-Martial Trial. IAW FAR 6.302-3, Full and open competition need not to be provided for when it is necessary to award the contract to a particular source or sources in order to acquire the services of an expert or neutral person for any current or anticipated litigation or dispute. Contracts awarded using this authority shall be supported by the written justification and approval described in FAR 6.303 and FAR 6.304.
