- The National Endowment for the Arts (NEA) intends to issue a sole source commercial item purchase order, using FAR Part 13.105(b) Simplified Acquisition Procedures in accordance with FAR 5.101(a)(2), with only one responsible source that will satisfy the agency's requirement with Kator, Parks, & Weiser P.L.L.C for legal services. The NEA is currently in the midst of an EEO investigation and legal services are required for the next phase of litigation. Kator, Parks, & Weiser P.L.L.C has developed a full range of understanding of the Agency and of the particular case. The specific circumstances of this case require that we continue working with the law firm that researched and drafted the Agency's response brief and provided legal advice to the Agency regarding the case. Moreover, to have the most effective case continuity, indepth knowledge of this case, which will have a multitude of time-sensitive actions that must take place in the phases of pre-discovery, discovery, mediation (if scheduled), motions, replies, legal advice to the Agency, hearing preparation and the hearing demand we stay with this firm. This notice is for informational purposes only. This notice of intent is not a request for competitive quotes or proposals nor will a formal solicitation be issued. A determination by the Federal Government not to compete with this proposed contract action based upon responses to this notice is solely within the discretion of the Federal Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The NAICS code is 541110 and small business size standards in millions of dollars is $10.
