- Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, VA Ann Arbor Medical Center VA Ann Arbor Healthcare System 2215 Fuller Road (54 P&C) Ann Arbor, MI 48105 2.Nature and/or Description of the Action Being Processed: This document documents the justification and approval for use of the use of other than full and open competition as authorized under FAR 6.302-1 a(2) One Responsible Source. 3.Description of Supplies/Services Required to Meet the Agency's Needs: A consignment contract with Medtronic Inc. for various stents, balloons, filters, and guide wires used for a variety of purposes during surgeries. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(g), as implemented by FAR 6.302. (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): These are supplies for cardiac catheterization procedures in the Cardiac Catheterization and Electrophysiology Laboratories from Medtronic. The supplies are selected based on their specific use during procedures and often times, supplies from several vendors may be used during one procedure based on what the Surgeons find during the procedure. Consignment contracts allow the VA to keep several of these short shelf life items in the facility without having to buy them until they are used. The items requested meet the strict requirements of quality and functionality for which procedures they are chosen for. The VA Ann Arbor Healthcare System maintains several consignment contracts simultaneously but each is put in place as a sole source contract so that the facility can stock that particular vendor's supplies. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Talks with the vendor's sales staff and internet searches have revealed that this vendor is the only vendor that is willing to enter into an contract of this nature. If it is discovered that there are other sources that will enter into this type of a contract, the facility is willing to try those products or enter into a contract competitively. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The contracting officer will determine the proposed prices fair and reasonable prior to contract award. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: GSA was searched, vendor sales representatives were talked to and the research determined that no other Government contracts were available to provide these supplies on a consignment basis. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Should a procurement of this nature reoccur, the market will again be surveyed to locate possible new sources. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. _____________________________ ________________________ NameDate Title Facility 13.Approvals in accordance with FAR 6.304 a.Contracting Officer's Certification (required): I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. _____________________________ ________________________ NameDate Title Facility b.NCM/PCM (Required $3K and above): I certify the justification meets requirements for other than full and open competition. _____________________________ ________________________ NameDate Network Contract Manager VISN/PCA X Title Facility
