- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 20, for the Walla Walla VA Medical Center. Contracting Specialist is Philip Cyphers 360-816-2782. 2.Nature and/or Description of the Action Being Processed: This is a reoccurring contract action which will be awarded as a firm fixed price for laboratory supplies needed for testing purposes at the Walla Walla VA Laboratory. The 2237 number for this procurement is 687-14-1-020-0009 and the purchase order number is VA260-14-P-7117. The requirement will consist of 15 various solutions used in laboratory testing such as Inoculum Saline, Potassium Hydroxide A and Alpha Naphthol A. This is an emergency requirement. 3.Description of Supplies/Services Required to Meet the Agency's Needs: This procurement under Purchase Request Number 687-14-1-020-0009 and Purchase Order Number VA260-14-P-7117 is for the urgent requirement of laboratory supplies needed for testing purposes at the Walla Walla VA Laboratory. The laboratory supplies are needed to preform needed tests for veterans and without the laboratory supplies testing will not be able to be completed. If the tests are not completed this would most likely have an unnecessary negative impact the veterans heath care and could even result in the death of a patient if a proper and timely diagnosis is not given. This is an emergency requirement and the laboratory supplies purchase order needs to be in place no later than 10-1-2013, otherwise patient care will be severely impacted. "Estimated Dollar Value: $7,449.04 "Period of Performance: 10-1-2013 thru 9-30-2014 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The preferred vendor on the 2237, Siemens Healthcare Diagnostics, a large business, is the exclusive seller of the needed laboratory supplies. Also, the needed laboratory supplies are on Siemens FSS contract V797D-30175. Unfortunately, they are only available to purchase off of their FSS contract if the instrument and service are added to the laboratory supplies. The Walla Walla VA does not have a need for the instrument and service. Thus, the laboratory supplies are considered an open market purchase. In addition, when Cathy Knutsen the Government Sales Director at Siemens Healthcare Diagnostics, was asked if they had distributors they sold thru, she responded that they do not sell thru distributors. Please see a copy of the email form Cathy Knutsen in the briefcase of this order. The requested laboratory supplies will be purchased using an open market purchase order, an urgent and compelling need exists and following the open market large business ordering procedures would result in unacceptable delays. The critical laboratory supplies are needed to preform tests for veterans and without laboratory supplies, testing will not be able to be completed. If the tests are not preformed, this would most likely have an unnecessary severe negative impact the veterans heath care and could even result in the death of a patient if a proper and timely diagnosis is not given. Thus, delay in the award would cause patient harm by delaying the medical facility's ability to provide laboratory testing to patients in a manner necessitated by their plan of care. Therefore, in order to get the needed purchase order awarded for laboratory supplies by 10-1-2013, Siemens Healthcare Diagnostics was selected as the appropriate vendor. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Extensive market research was conducted, and IAW FAR part 8.002(1)(i) agency inventories (VA excess), (ii) Government Excess (www.gsaxcess.gov), UNICOR (www.unicor.gov), and Ability One (www.abilityone.gov) were checked and they do not carry similar items. Also, further market research was done, IAW FAR 8.0002(v) for wholesale supply sources (www.gsaadvantage.gov and www.gsaelibrary.gsa.gov) which uncovered at least 3 vendors under the GSA/FSS umbrella who could provide similar items. IAW FAR 8.405-1(c)(1) the request was posted to GSA eBuy from 8-23-13 through 8-30-13. The GSA eBuy solicitation yielded 1 quote and 3 no quotes for the solicited item. Unfortunately, the item bid on by Siemens Healthcare Diagnostics, a large business, were open market items and not on their FSS Schedule. Therefore, the FSS solicitation was cancelled and the requirement was set aside for small business. The request was posted as a brand name or equal to RFQ solicitation with a total small business set aside to Fedbid from 9-10-13 through 9-26-13. The Fedbid solicitation notified 5,008 small business open market vendors who provide similar items, which yielded 1 quote and 119 no bids for the solicited item. The one bid was received by Cen-Med Enterprises bid amount was $36,430.70, which is 515 percent higher than the IGCE for this procurement as well as historical pricing. Therefore, the a brand name or equal to RFQ solicitation with a total small business set aside will be cancelled due to the bid by Cen-Med Enterprises, bid price is not fair and reasonable. Thus, requested laboratory supplies will be purchased using an open market purchase order, an urgent and compelling need exists and following the open market large business ordering procedures would result in unacceptable delays. John Kopp, Supply Team A Manager, was contracted on 9-30-13 requesting the use of FAR Part 6.302-2 Urgent and Compelling emergency procedures in order to get the critical purchase order awarded for laboratory supplies by 10-1-13. Approval was given, emergency procedures were used, and the requirement was put in place on 10-1-13 using purchase order number VA260-14-P-7117 (687-A40003). 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: IAW FAR 13.106-3(a)(1), the quote from Siemens Healthcare Diagnostics is fair and reasonable based on competitive quotes and offers, see offers listed above and located in the briefcase of this order. Also, IAW FAR 13.106-3(a)(2)(ii) comparison with previous purchases (687-A30003), and (iii) current price lists, provided by Siemens Healthcare Diagnostics via an updated FY14 spreadsheet and (vii) the reasonable basis that the IGCE for this procurement is $7,047.84 and the FY14 pricing is $7,449.04, which is 5.7 percent increase, I determine that the quote from Siemens Healthcare Diagnostics is fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: FAR Part 10 directs that market research be conducted on each acquisition appropriate to the circumstances. Market research was conducted for this procurement and mandatory sources were queried in order of priority, see the Market Research document in the briefcase. Research results serve to confirm, due to the urgent and compelling nature of this procurement, that Siemens Healthcare Diagnostics is the necessary choice. Please see block 6 for a full and detailed explanation. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: No other facts to report. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: One other bid was received by Cen-Med Enterprises, but their bid amount was $36,430.70, which is 515 percent higher than the IGCE for this procurement as well as historical pricing. Therefore, the a brand name or equal to RFQ solicitation with a total small business set aside was cancelled due to the bid by Cen-Med Enterprises, bid price is not fair and reasonable. Also, it is most likely that Cen-Med Enterprises was simply marking up the lab supplies sold by Siemens Healthcare Diagnostics. This is a reasonable assumption since Siemens Healthcare Diagnostics does not sell its laboratory supplies through distributors, which has been confirmed by Cathy Knutsen the Government Sales Director. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Always preform extensive market research that includes searching for other vendors who could provide similar items.
