Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is HHS-NIH-NIDA(SS-SA)-2014-PS3167640 and the solicitation is issued as a pre-solicitation notice of intent to award a non-competitive order to Beckman Coulter Inc, 250 S. Kraemer Blvd, Brea, CA 92821. This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-05-70, dated September 30, 2013 A notice regarding any set-aside restrictions, the associated NAICS code 334516 and the small business size standard 500 employees. This acquisition is being conducted in accordance with the procedures of FAR Part 13-Simplified Acquisition Procedures, FAR Subpart 13.5-Test Program for Certain Commercial Items, and FAR Part 12-Acquisition of Commercial Items. The National Institutes of Health, National Institutes of Drug intends to procure on a sole source basis the Total Plus Support on the Beckman Coulter MoFlo Astrios Flow Cytometer Cell Sorter for one year. 1. NIH WIDE CONTRACT GOAL AND SCOPE: This Contract is for use by the entire NIH community having Government-owned Beckman Coulter Manufactured instruments of the type specified in the contract. The goal is to ensure that the instrumentation remains operational and performs in accordance with its original equipment manufacturers operational specifications. Contractor to provide all labor, material and equipment to provide preventive maintenance for the government owned Beckman Coulter Instrumentation. 2. PREVENTIVE MAINTENANCE: Contract shall perform not less than one (1) preventive maintenance inspection during the contract period. Service shall be performed by a factory trained Field Service representative. Service shall consist of, but not limited to, inspection, examination of all functioning parts, thorough cleaning, proper lubrication, replacement or repair of worn or unserviceable parts, adjustment and calibration made with the expressed intent of maintaining the instrument to the manufacturer's original specifications. When necessary, this includes complete dismantling, parts replacement, reassembly and thorough testing and adjusting. 3. EMERGENCY SERVICE: Emergency repair service shall be provided on a unlimited basis during the basis during the term of this contract at no additional cost to the Government. Emergency service shall be provided between 8 am and 5 pm Monday through Friday excluding weekends and Federal holidays. Upon receipt of notice that any part of the equipment is not functionally properly, the Contractor shall furnish a factory-trained service representative to inspect the equipment and perform all repairs and adjustments necessary to restore the equipment to normal and efficient operating condition. 4. REPLACEMENT PARTS: The contractor shall furnish all required replacement parts at no additional cost to the Government, with the exception of consumable parts. Parts shall be new or remanufactured to original equipment specifications. 5. SERVICE EXCLUSIONS: The contractor shall not be responsible for any repairs necessitated by abuse, neglect, vandalism, Acts of God, fire or water. These repairs shall be the subject of a separate purchase order and shall not be performed under this contract. 6. PERIOD OF PERFORMANCE: 11/23/2014 to 11/22/2014 7. PERSONNEL QUALIFICATIONS: Personnel shall be factory trained and have experience in the servicing Beckman Coulter instrumentation. All primary service personnel shall have at least one backup Field Service representative with at least the same level of expertise on the equipment covered by this contract. 8. PLACE OF PERFORMANCE: Service shall be performed at the customer/instrument location. The contractor shall perform the work required under this contract at the NIH Bethesda, MD campus and other NIH facilities within a 50 mile radius of the Bethesda, MD campus. The provision of FAR clause 52.212-1, Instructions to Offerors - Commercial Items (July 2013), applies to this acquisition. The provision of FAR clause 52.212-2, Evaluation - Commercial Items (January 1999), applies to this acquisition. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Offeror must include a completed copy of the provision at FAR clause 52.212-3, Offeror Representations and Certifications - Commercial Items (August 2013), with its offer. The FAR clause is located at http://www.acquisition.gov/far/. FAR clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (September 2013), applies to this acquisition. There are no additional contract requirement(s) or terms and conditions determined by the contracting officer to be necessary for this acquisition and consistent with customary commercial practices. The Defense Priorities and Allocations System (DPAS) is not applicable to this requirement. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by November 22, 2013 at 1:00pm EST and must reference number HHS-NIH-NIDA(SS/SA)-2014-PS3167640.
