- This is a combined Synopsis/Solicitation/Notice of Intent for commercial items prepared in accordance with the format of FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are not being requested, and a written solicitation will not be issued for the solicitation number NIAID-NOI-14C-1654063, Notice of Intent. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-70, dated September 30, 2013. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a small business set-aside, however small disadvantage, minority, veteran owned and HUB zone companies etc., are encourage in submitting a proposal. The associated North American Industry Classification System (NAICS) Code is 325199, which has a size standard of 1000. The National Institute of Allergy and Infectious Diseases (NIAID) intends to procure on a sole source basis from Life Technologies Corporation: Five hundred (500) each of the 293fectin Transfection Reagent catalog #12347-019. This requirement is a standing order from date of award for a period of one (1) year with orders being placed on an as needed basis. NIAID has been using 293fectin reagent for protein production for many years and it has proven to support high production of the proteins that are required for protocols in the development of vaccines for HIV and other viruses. The lab must maintain past reagent protocols and standards to insure experimental results are not influenced by other variables. Any attempts to change reagents at this point would provide results inconsistent with previously gathered data, and will result in extensive testing, and delay in the production of materials for vaccine development and trials. The following factors shall be used to evaluate offers: 1) capability to meet the required salient characteristics, 2) price, and 3) delivery (standing order to Bethesda, Maryland 20892). This will be a firm fixed price contract. The FOB terms are 'Destination: and Net 30. The following Federal Acquisition Regulation provisions and clauses apply to this acquisition: FAR 52.212-1 Instructions to Offerors - Commercial Items; FAR 52.212-2. Evaluation - Commercial Items: FAR 52.212-3 Offeror Representation and Certifications Commercial Items; FAR 52.212-4 Contract Terms and Conditions - Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial; and FAR 52.232.33 Payment by Electronic Funds Transfer - System for Award Management (July 2013). A completed copy of provisions at FAR 52.212-3 Offerors Representation and Certifications Commercial Items must be included, which can be found online at System for Award management (SAM) https://www.sam.gov. By submission of an offer, the Offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation. [Note: Lack of registration in SAM will make an Offeror ineligible for award.] Copies of the aforementioned clauses are available online at the website www.acquisition.gov. All responsible sources may submit offers that will be considered by this agency.
