Description
This is a Pre-Solicitation Notice. The Department of Veterans Affairs, VISN 16, intends to enter into a Sole Source contracting agreement with Swank Motion Pictures. The requirement is for the procurement of Patient Entertainment Services. The designated North American Industry Classification Systems (NAICS) code for this procurement is 512120 -Motion Picture and Video Distribution with a size standard of $29.5 million. This synopsis is for notification purposes only and does not constitute a solicitation for bids, quotes, or proposals. The performance period shall include a base period (FY14), and four (4) one year option periods to be exercised at the discretion of the Government. The service is for Veteran's patient rooms, and public waiting areas of hospitals and Community Based Outpatient Clinics (CBOC). Media content shall be delivered directly to patient rooms and public waiting areas of hospitals, and CBOC's via closed circuit television. The geographical footprint of VISN 16 encompasses LA, AR, TX, OK, and MS. The service shall include first-rum motion pictures from movie studios to include Walt Disney Pictures, Warner Bros., MGM, United Artists, Columbia Pictures, Universal Pictures, Touchstone Pictures, Sony Pictures, Screen Gems, TriStar Pictures, DreamWorks Pictures, Miramax Films, CBS Films, Cohen Media, eOne Entertainment, Focus Features, Gaiam/Vivendi Entertainment, Hallmark Hall of Fame, HBO, Image Entertainment, Lions Gate Films, Inc., Summit Entertainment, Magnolia Pictures, Millennium Entertainment, Monterey Media, Open Road Films, Relativity Media, Newline Cinema and The Weinstein Co. Patient Entertainment programming shall consist of a minimum of 28 motion pictures, with at least seven pictures rotated out of the program and replaced by seven new pictures each quarter. All motion pictures shall be appropriately selected and sensitively edited for hospital standards and patient enjoyment. The patient entertainment programming shall be delivered via contractor-provided equipment that shall provide continuous automated digital entertainment at the facility. Additional authorities governing this requirement include FAR part 12 - Acquisition of Commercial Items, and FAR part 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. A justification for other than full and open competition has been prepared in support of this acquisition. All responsible sources may submit a capability statement, proposal or quotation which shall be considered by the agency. Responses to this notice, if any, must show clear and convincing evidence that competition is attainable and more advantageous to the Government. Response shall be forwarded to the Contracting officer via email and received by December 9, 2013 at 08:00 a.m. CST. Information received will normally be considered solely for the purpose of determining whether to solicit this requirement as a 'full & open' competitive procurement. To be considered for award firms must be registered in the SAM System for Award Management (SAM) database. Information on registration requirements can be obtained at https://www.sam.gov. Firms may also complete and submit annual Online Representations and Certifications (ORCA) at https://orca.bpn.gov. All registrations must be accomplished prior to contract award. No solicitation will issued; this 'Notice of Intent' to Sole-Source is not a request for competitive bid, quotes, or proposals. A determination not to compete this proposed contract action is solely within the discretion and authority of the Government.
