Description
This notice is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. Kennedy Space Center (KSC) has a requirement for Me'scopeves Software.This notice is being issued as a Request for Quotation for the following: Line Item 1: Me'scopeves Vt-570 Visual Modal Perpetua Delivery of Me'scopeves Software is due no later than December 13, 2013. Quotation must reflect that the delivery date can be met. Evaluation criteria are technical acceptability and overall lowest cost. It is critical that offerors provide adequate product and delivery detail to allow evaluation of the offer.(SEE FAR 52.212-1(b)). Offers for the items(s) described above are due by November 29, 2013, 4:30 PM (EST) via email to kristina.irastorza@nasa.gov. Response via email is required. Questions must be received in writing (email) by 10:30 PM EST on November 27, 2013, to the identified point of contact. Oral communications are not acceptable in response to this notice. All responsible sources may submit an offer which shall be considered by the agency. An ombudsman has been appointed -- See NASA Specific Note 'B'. The provisions and clauses in the RFQ are those in effect through FAC 2005-66B. The NAICS Code and the small business size standard for this procurement are 423430, 100 employees respectively. The offeror shall state in their offer their size status for this procurement. The DPAS rating for this procurement is DO-C9. Offers must include solicitation number, FOB destination to KSC, proposed delivery schedule, discount/payment terms, warranty duration (if applicable), taxpayer identification number (TIN), identification of any special commercial terms, and be signed by an authorized company representative. Offerors must include completed copies of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items with their offer. These may be obtained via the internet at URL: http://prod.nais.nasa.gov/eps/Templates/Commercial_Greater_Than_25K.doc. These representations and certifications will be incorporated by reference in any resultant contract. Prospective offerors may notify this office of their intent to submit an offer. If the end product(s) offered is other than domestic end product(s) as defined in the clause entitled 'Buy American Act -- Supplies' the offeror shall so state and shall list the country of origin. Offerors shall provide the information required by FAR 52.212-1 (FEB 2012), Instructions to Offerors-Commercial, which is incorporated by reference. In accordance with FAR 52.212-1(k), the Contractor shall be registered within the Central Contractor Registration (CCR) database. (JUNE 2013) (DEVIATION) (a) Definitions Acquire means procure with appropriated funds by and for the use of NASA through purchase or lease. Entity owned, directed or subsidized by the Peoples Republic of China means any organization incorporated under the laws of the Peoples Republic of China. Information Technology (IT) System means the combination of hardware components, software, and other equipment to make a system whose core purpose is to accomplish a data processing need such as the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission or reception of data. IT systems include ground systems in support of flight hardware. IT systems do not include (i)Systems acquired by a contractor incidental to a contract; (ii)Imbedded information technology that is used as an integral part of the product, but the principal function of which is not the acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information. For example, HVAC (heating, ventilation, and air conditioning) equipment such as thermostats or temperature control devices, and medical equipment where information technology is integral to its operation, are not information technology systems; (iii)Services in support of IT systems, such as help desk services; or (iv)Flight hardware, which includes aircraft, spacecraft, artificial satellites, launch vehicles, balloon systems, sounding rockets, on-board instrument and technology demonstration systems, and equipment operated on the International Space Station; as well as prototypes, and engineering or brass boards created and used to test, troubleshoot, and refine air- and spacecraft hardware, software and procedures. (b) Section 516 of the Consolidated and Further Continuing Appropriation Act, 2013 (Pub. L.113-6), requires NASAs Office of the Chief Information Officer (OCIO) to assess the risk of cyber-espionage or sabotage of an information technology (IT) system that is produced, manufactured, or assembled by an entity owned, directed or subsidized by the Peoples Republic of China. By submitting an offer in response to this solicitation, the Offeror understands and agrees that the Government retains the right to reject any offer or response to this solicitation made by the Offeror, without any further recourse by, or explanation to, the Offeror, if the Government determines the Offeror or the equipment or software offered by the Offeror, in whole or in part, presents an unacceptable risk to national security. (c) Representation. The Offeror represents that any information technology system offered, except those listed in paragraph (d) of this provision, is not produced, manufactured, or assembled by an entity owned, directed or subsidized by the Peoples Republic of China.
