Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Salem, VA Medical Center Surgical Care Service Line. This request is submitted for other than full and open competition for the procurement of Laser Therapy through Falls Church Laser for the period of November 4, 2013 through March 31, 2014, purchase request 658-14-1-032-0004. 2.Nature and/or Description of the Action Being Processed: A firm fixed price requirements contract will be awarded for the five month period to obtain laser surgical services for the Salem VAMC while a follow-on contract is prepared. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Salem VAMC requires Holmium YAG Laser System services and Greenlight Laser services. The estimated award value is $60,000. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Fortec Medical has been providing these services at the Salem VAMC and currently holds all required certifications and can provide the necessary equipment for surgeries at the Salem VAMC. This purchase order will be used to procure services while a five year contract is competed. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the surgical needs at the Salem VAMC, award will be made to Falls Church Laser through 3/31/14 while a long term contract is competed. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The cost of the services are considered to be fair and reasonable based prior contact pricing and through comparison of the cost of similar services at other VISN-6 medical centers. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research indicates that other sources are available for this service. A competitive RFQ will be issued for the follow-on contract. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A solicitation to obtain services over a five year period (base year plus four option years) is currently under review and will be released this winter. The anticipated contract start date is 4/1/2014.
