Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above {applicability of authority): Intuitive Surgica I is the sole manufacturer of this instrument as it is designed to work exclusively with their proprietary DaVinci Surgical Robotics System. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted by issuing a Sources Sought notice on FBO to see if other potential sources can fulfill this need, but due to the proprietary nature of the requirements, Intuitive Surgical was found to be the only responsible source. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost to the Government is$ 47,095.00. The cost is deemed fair and reasonable based on Intuitive commercial pricing list. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:Market research was conducted by issuing a Sources Sought notice on FBO and NAICS code and internet product search. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: Intuitive Surgical has been providing all the supplies and maintenance for the DaVinci Robot for the past five years. As per current market analysis; there is no other provider able to provide service or maintenance support with the current device in-place. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No other interested sources were contacted. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Under the authorities and actions cited above, there are no actions to be taken to overcome barriers to competition. 12.Requirements Certification: Icertify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
