- This is the Justification and Approval document supporting the sole source contract action. Under the authority of FAR 8.405-6(a)(1) and as instructed by FAR 8.405-6(a)(2), the Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP) is publishing this notification to industry of a Federal Supply Schedule (FSS) Task Order award supported by a limited sources justification. On December 9, 2013, CBP issued a Firm Fixed Price Task Order under the General Services Administration (GSA) Mission Oriented Business Integration Services (MOBIS) Multiple Award Schedule (MAS) contract, Special Item Number 874-1 to Creative Computing Solutions, Inc. (CCSi). CBP awarded Task Order Number HSBP1013F00012 on a sole source basis to CCSi as the incumbent contractor to obtain follow-on Biometric Watch-list analytical support services for a short duration period of performance from December 9, 2013 through May 23, 2014. This is a limited sources acquisition under FAR 8.405-6(a)(1)(i)(B) which states, in pertinent part, that an ordering activity may be justified in limiting sources of supply when "[o]nly one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." 48 C.F.R. §8.405-6. Award of a follow-on task order to any source other than the incumbent in this case would result in cost inefficiencies and create unacceptable delays in fulfilling agency requirements. Any cost efficiencies reasonably expected to be gained through competition would be lost in the transition period to a successor contractor, particularly given the short duration of the proposed follow-on task order. Since the government proposes only a six (6) month period of performance for this follow-on task order to afford an opportunity to complete its hiring actions and federalize this work, CCSi as the incumbent is the only source reasonably available that is capable of providing continued Biometric Watch-list support services to CBP for the follow-on task order. A sole source award to the incumbent is the most efficient and economically viable option to ensure the government will receive continued Biometric Watch-list support services at the level of quality required without disruption or delay while the government transitions this work to federal employees. Under this task order, the contractor shall provide Biometric Watch-list research and analysis support services to assist CBP Office of Field Operations (OFO) personnel with maintenance of the DHS Automated Biometric Identification System (IDENT) database. Contractor personnel shall also assist CBP Officers in coordination and liaison activities with other government agencies concerning foreign nationals applying for U.S. immigration benefit or otherwise seeking legal admission into the United States. Contractor personnel shall further assist CBP personnel in research, analysis and information sharing with other government agencies and the National Intelligence Community on matters pertaining to individuals seeking entry into the United States whom are of National Security interest. In performing these support services, contractor personnel shall have access to, and be proficient in the use of, several disparate systems and databases.
