POSITION: Criminal Justice Advisor U.S. Embassy Dushanbe, Tajikistan Issuance Date: 12/30/2013 Closing Date: 01/26/2014 SOLICITATION NUMBER: PSC-14-016-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. HOW TO APPLY Offeror's proposals shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. POSITION TITLE: Criminal Justice Advisor 6. MARKET VALUE: $80,728 - $118,552 (FS-02 Equivalent) 7. PERIOD OF PERFORMANCE: One year from date of award and four option years 7. PLACE OF PERFORMANCE: Dushanbe, Tajikistan 8. JOB DESCRIPTION: See below GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT AND RESPONSIBILITIES OF THE CONTRACTOR: The International Law Enforcement and Narcotics (INL) Section in the U.S. Embassy in Tajikistan coordinates and implements law enforcement, border security and criminal justice technical assistance programs in Tajikistan funded by the Department of State in accordance with an agreement between the U.S. and the Government of Tajikistan (GOTI). INL's strategy in Tajikistan aims to reform Tajikistan's law-enforcement and justice-sector institutions so that its criminal justice system is more responsive to the needs of its citizens and communities. INL Dushanbe's justice sector programs aim to strengthen the rule of law and ensure the protection of the legal rights and human rights. A major project implemented by the American Bar Association's Rule of Law Initiative addresses reform of the defense bar and rule of law education. INL also develops rule of law in Tajikistan by conducting legal training for judges, defense attorneys, and law students; improving access to justice; strengthening local bar associations; reforming the existing criminal code; and monitoring court cases to ensure compliance with local and international norms. INL's community policing program supports the goal of promoting criminal justice sector reform. Community policing is aimed to generate an understanding of and support for democratic and community-oriented policing among key leaders in the GOTI Ministry of Internal Affairs (MIA), and improve trust between the police and the community, by building collaborative police-community partnerships. The INL Section home bureau is Department of State's Bureau for International Narcotics and Law Enforcement Affairs (INL). The Office of Europe and Asia (INL/EA) programs provides direction for the law enforcement, rule of law and counternarcotics policies and program direction in accordance with U.S. foreign policy objectives throughout Europe and all of Asia, excluding Afghanistan and Pakistan. Purpose The purpose of this PSC position is to provide Criminal Justice Advisor (CJA) to the INL Section in the U.S. Embassy in Dushanbe, Tajikistan. The advisor will manage the day-to-day implementation, direction, execution and oversight of community policing and justice sector reform projects to promote a more responsive criminal justice system accountable to the needs of Tajik citizens. The CJA will also support INL program development and assist in the implementation of the other law enforcement and counternarcotics portfolios in Tajikistan. Relationship The CJA reports to the INL Director at U.S. Embassy Dushanbe, Tajikistan. The INL Director will annually evaluate the CJA's performance, based on the duties and responsibilities outlined herein and the interpersonal relationships within the Embassy, host government, and international and local partners. Duties and Responsibilities 1) Manage INL criminal justice assistance programs, including performing needs assessments, design and development, coordination with other USG entities and international donors, selection of project implementers, and monitoring and evaluation. 2) Provide policy analysis to the INL Director on improving the capacity of the police to serve its citizens, particularly in areas related to community policing and drug demand reduction, in keeping with the internationally coordinated Tajik police reform process. 3) Provides policy analysis to the INL Director on developing justice sector reform initiatives, particularly in the area of criminal defense education, training, and capacity. 4) Draft/review technical and programmatic documents, including funding and information memoranda and letters, project work plans, budgets, and reports, talking points, briefing materials, official informal entries, and official cables. 5) Coordinate and communicate INL approved policies on police and criminal justice reform programs with U.S., international and GOTI agencies. As directed, participate in outreach activities with host country and international law enforcement members to increase awareness of INL programs and policies. 6) Design and develop community policing activities to ensure the continuity and sustainability of the established network of Community Policing Partnership Teams and Community Policing Centers, and oversee their implementation. 7) Monitor and evaluate program activities' effectiveness and application methods to ensure compliance achievement with acceptable international standards and intended and unintended impact. 8) Establish and maintain collaborative working relationships with Tajik law enforcement as well as civil society actors working to promote police reform and the Rule of Law in Tajikistan. Advise INL Director, GOTI and Embassy contacts on training requirements and on appropriate types and levels of support needed to initiate and sustain INL-funded projects. 9) Advise the Ministry of Internal Affairs on best practices for institutionalizing community policing, including organizational changes, tactical, operational, and strategic planning, training, and community outreach and engagement. 10) Provide programmatic guidance on developments in the Tajik criminal justice system to the INL Director, the Mission and others, and work with the Ministry of Justice (MOJ) on judicial reform, providing advice on best practices and international norms. 11) Coordinate with the OSCE-led Police Reform Steering Group and Working Groups to ensure INL's community policing initiatives complement police reform activities. Minimum Requirements 1) U.S. citizen, able to obtain and maintain DOS Secret security and Medical clearances. 2) Ten (10) years' experience in management, organizational development, planning and strategic development (including evaluation of effectiveness and assessment of impact), project management, and training. 3) Three years' experience in general administrative and program management of international criminal justice reform or community policing programs in foreign countries, including preparation of budgets, procurement of goods and services, and project implementation and oversight. 4) Demonstrated knowledge of police development in transitioning societies and the establishment of democratic policing systems, to include police reform. 5) Demonstrated substantive knowledge of community policing principles and practices and credible experience in developing and implementing community-policing programs. 6) Demonstrated ability to provide expert program and policy guidance to senior-level policy makers. 7) Demonstrated excellent oral and written communication skills. 8) Proven ability to work and liaise well with others, including a variety of governmental, civil society, and private sector representatives. 9) Proven high-level flexibility and ability to work under pressure and within limited timeframes. 10) Proven ability to build local capacity and mentor foreign staff members. 11) Proven ability to draft analytical documents for internal and external use. 12) Proficient in Microsoft Office programs, such as Word and Excel. 13) Ability to complete the Foreign Service Institute's Contracting Officer's Representative (COR), Grants Officer, Grants Officer's Representative (GOR) courses successfully within the first 90 days of assignment. Preferred knowledge and skills 1) Bachelor's degree from an accredited institution, in the field of criminal justice, law, international relations, or a related field. 2) Experience coordinating and facilitating training, meetings, seminars, and workshops. 3) Experience working overseas with DOS, Department of Justice, and/or U.S. Agency for International Development. 4) Demonstrated experience working with law enforcement agencies on police reform. 5) Russian/Tajiki language skills. Position Elements 1) Relationships: The CJA will receive general guidance from, and report directly to, the INL Director. Specific assignments originate frequently from liaison activities, and the CJA must be able to draft and negotiate scope and objectives of criminal justice reform projects independently with little supervision. 2) Supervision Exercised: The CJA will direct work to locally hired staff serving as program management assistants for the Community Policing project, in coordination with the INL Director. 3) Guidelines: Guidelines include basic legislation, in particular, Chapter 8 of the Foreign Assistance Act (FAA) of 1961, authorities under the FAA, the Arms Export Control Act, provisions of DOD authorization acts, provisions of the annual Foreign Operations, Export Financing, and Related Program Appropriations Act, other supplemental appropriation laws, and the DOS Basic Authorities Act. 4) Complexity: This position involves planning, organizing, and completing analysis and implementation of complex law enforcement project activities. 5) Scope and Effectiveness: The CJA completes extensive assignments in support of the MVD's community policing activities, in coordination with the broader police reform process. The CJA will perform a broad range of tasks related to providing community policing expertise for the Embassy's INL section, which has a significant profile in embassy operations. 6) Personal Contacts: The CJA works closely with the INL Director, INL staff, other Embassy personnel, and project implementers. In addition, the CJA will maintain contact with MVD staff, other law enforcement agencies as needed, and international and non-governmental organizations. The CJA works closely with INL Office of Europe and Asia Programs (INL/EA) in Washington, D.C., as well. 7) Travel: Periodic travel in Tajikistan is required. Occasional international travel for training, conferences, or other events may be authorized. 8) Work Environment: The position is located at U.S. Embassy Dushanbe. Tajikistan is a developing country in which facilities and services are well below the standard in the developed world, particularly in rural areas outside the capital. The CJA shall implement activities in challenging political, social, and physical environments. 9) Level of Effort: The level of effort required over the period of this contract is 100%. The position is full-time, with a minimum of 40 hours per week. Occasional work on weekends or after regular work hours is required. Evaluation Factors Factor 1 Program Development and Management Experience (20 points) Ability to assess needs, develop program plans, draft project budgets, and implement police reform and law enforcement development programs that support USG objectives. Factor 2: Interpersonal Skills (20 points) Ability to build collaborative relations with members of relevant USG agencies, host-government representatives, international and local organization representatives, and local police and community members in developing, implementing, and coordinating criminal justice reform and/or community policing projects. Factor 3 Subject Area Expertise (20 points) Expert working knowledge of criminal justice reform, including community policing and Rule of Law principles, and demonstrated skills and experience managing community policing programs, particularly in developing countries. Factor 4 Communication Skills (20 points) Ability to explain difficult concepts in writing and speaking, report on achievements clearly, conduct meetings efficiently, and persuade interlocutors diplomatically to support various program activities. Factor 5 Teamwork (10 points) Ability to work cooperatively with American and foreign national staff in a way that is responsive to staff needs, builds team cohesion, and motivates individuals to achieve shared goals and deliver quality work. Factor 6 Past Performance (10 points) Evaluation of applicant's ability to perform under the contract. Note: In conducting the evaluation, the USG reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. Pre-Award Ethical Responsibilities of PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award.
