- This notice updates the prospectus issued on November 26, 2013. Please note that in addition to specific deletions and replacements listed below, this Amendment provides a complete replacement of the original Proposal Package (Section III) published with the Prospectus, which necessitates the replacement of Appendices 9 and 10. All Offers should use the new Proposal Package and Principal Selection Factor 4 spreadsheets only. Also, the due date for proposals has been extended until 4:00 p.m. MST on Monday February 10, 2014. In response to the questions received by the question deadline, December 20, 2013, the National Park Service (NPS) has made a change in terms of the treatment of Subconcessioners. In summary, the NPS will not require an Offeror to specifically identify proposed Subconcessioner(s) nor provide detailed information regarding these Subconcessioner(s) at the time of an Offeror's proposal submission. However, within seven (7) calendar days of an Offeror being notified that it has been selected for award, the Offeror must identify its Subconcessioner(s) and submit the requested information as specified in the Offeror's Transmittal Letter (as revised). If the selected Offeror fails to provide this information or the NPS determines that the information provided is inadequate, the NPS will consider the Offeror's proposal non-responsive and another Offeror will be awarded the Contract. Based on the above change regarding Subconcessioners, several portions of the Proposal Package have changed. In the revised version of the Proposal Package, the additions and revisions have been underlined and deletions have been marked with a strikethrough for ease of identification.. Business Opportunity Summary Page 3 To first paragraph, under header "Historical Gross Revenue" add the sentence: These historical gross receipts may include revenue from summer season road-based transportation, which is not an authorized service in the Draft Contract. Business Opportunity Summary Page 4 Delete: A successful Offeror should demonstrate it has or will have the capacity to operate the full allocation of OSV transportation events at any point during the Draft Contract. If an Offeror applies for more than one Contract, the Offeror should demonstrate that it has or will have the capacity to operate the full OSV allocation under each Contract at any point during the Draft Contract, up to the maximum number of contracts the Offeror has the capacity to conduct as described in the Transmittal letter. Replace with: A successful Offeror should demonstrate it has or will have the capacity to operate the full allocation of OSV transportation events during year one of the Draft Contract. If an Offeror applies for more than one Contract, the Offeror should demonstrate that it has or will have the capacity to operate the full OSV allocation under each Contract during year one of the Draft Contract, up to the maximum number of contracts the Offeror has the capacity to conduct as described in the Transmittal letter. Business Opportunity Page 12 Delete: The staging areas for snowmobile and snowcoach trips entering the Area are: Mammoth Hot Springs, near the North Entrance; Pahaska Teepee in the Shoshone National Forest three miles from the East Entrance; Flagg Ranch two miles from the South Entrance; and West Yellowstone adjacent to the West Entrance. Replace with: The staging areas for snowmobile and snowcoach trips entering the Area are: outside the North Entrance; Pahaska Teepee in the Shoshone National Forest three miles from the East Entrance; Flagg Ranch two miles from the South Entrance; and West Yellowstone adjacent to the West Entrance. Business Opportunity Page 15 Exhibit 13 Concession Operated Winter Visitors Services by Geographic Area Delete from row labeled East Entrance: text beginning "at Pahaska Teepee..." because these are services not operated by NPS concessioners. Business Opportunity Page 16 Under heading Personal Property Investment, delete: Snowcoach tours require the use of an enclosed tracked vehicle capable of carrying a minimum of eight (8) passengers. Replace with: Snowcoach tours require the use of an enclosed vehicle capable of carrying a minimum of eight (8) passengers. Business Opportunity Page 17 Delete: A successful Offeror should demonstrate it has or will have the capacity to operate the full allocation of OSV transportation events at any point during the Draft Contract. Exhibit 15 demonstrates the Service's assumption of what constitutes a full allocation. If an Offeror applies for more than one Contract, the Offeror should demonstrate that it has or will have the capacity to operate the full OSV allocation under each Contract at any point during the Draft Contract, up to the maximum number of contracts that the Offeror has the capacity to conduct. Replace with: A successful Offeror should demonstrate it has or will have the capacity to operate the full allocation of OSV transportation events during year one of the Draft Contract. Exhibit 15 demonstrates the Service's assumption of what constitutes a full allocation. Business Opportunity Page 18 To Exhibit 15 Example of Vehicle Investments by Contract, add the following sentence to the footnote under the table: *This table represents different ways an Offeror could meet the full allocation of transportation events under each Contract. The Service assumes the Concessioner is using its full allocation of snowmobiles if it is averaging 7 snowmobiles per transportation event. Business Opportunity Page 18 Subconcessions Delete: The Concessioner may enter into one or more subconcession contracts to offer guided OSV transportation events to visitors by either snowcoach or by snowmobile, but not by both, as the Concessioner shall remain solely responsible for all transportation events using the alternative type of oversnow vehicle. Replace with: The Concessioner may enter into no more than two subconcession contracts to offer guided OSV transportation events to visitors by either snowcoach or by snowmobile, but not by both, as the Concessioner shall remain solely responsible for all transportation events using the alternative type of oversnow vehicle. Proposal Package (Prospectus Section III) Delete existing Proposal Package and replace with new Proposal Package attached to Amendment #3. Draft Contract Addendum Page A1-3 Delete: (d) Subconcession Contracts. The Concessioner may enter into one or more Subconcession contracts with respect to the exercise by others of the privilege granted by this Contract to offer guided Oversnow Vehicle transportation events to visitors by either snowcoach or snowmobile, but not by both, as the Concessioner shall remain solely responsible for all transportation events using the alternative type of oversnow vehicle. Replace with: (d) Subconcession Contracts. The Concessioner may enter into no more than two Subconcession contracts with respect to the exercise by others of the privilege granted by this Contract to offer guided Oversnow Vehicle transportation events to visitors by either snowcoach or snowmobile, but not by both, as the Concessioner shall remain solely responsible for all transportation events using the alternative type of oversnow vehicle. Draft Contract, Appendix 1: Draft Subconcession Contract, Page Appendix 1-2 Delete: (e) Reservations/Bookings. All reservations, cancellations and refunds for Subconcessioner operations must be made through the Concessioner's reservation system. Replace with: (e) The Concessioner is ultimately responsible for the management of all reservations, cancellations, and refunds. The Subconcessioner may take reservations, cancellations, and bookings if it is made clear to the visitor that: 1) the Subconcessioner is acting as a Subconcessioner to the Concessioner under an NPS contract; and 2) the visitor may cancel through the Concessioner. The Concessioner and Subconcessioner must actively communicate on all of the Subconcessioner's reservations under the contract. Draft Contract, Appendix 1: Draft Subconcession Contract, Page Appendix 1-3 Delete: (b) Other Subconcession Fee(s) [Parties agree as appropriate.] Replace with: (b) The Concessioner shall pay to the Director within 45 days after the 31st of December each year or portion of year a sum equal to fifty percent (50%) of any and all fees, commissions, or compensation payable to the Concessioner thereunder other than the Subconcessioner's payment of franchise fees to the Concessioners. Draft Exhibit b: Operating Plan Page B-8 K) Entrance Fees - Pre-Authorized Debit Program / Voucher System Delete: The Concessioners pay entrance fees for guided OSV tours through the Pre-Authorized Debit (PAD) program. The Service will record OSV tour entry fees at the entrance station, by individual Concessioner, utilizing a 3-copy entrance voucher to track the fees. A Service employee will distribute a supply of blank vouchers, along with instructions, to each Concessioner prior to the operating season. The OSV guide must submit a completed voucher at the point of entry. The Concessioner should retain one copy; the guide will turn in one copy at the entrance and keep one copy during the trip. Replace with: The Concessioners pay entrance fees for guided OSV tours through the Pre-Authorized Debit (PAD) program. The Concessioner must enter into a Memorandum of Understanding with the Area to establish an agreement regarding the collection of entrance fees on behalf of visitors. The Service will record OSV tour entry fees at the entrance station, by individual Concessioner, utilizing a 3-copy entrance voucher to track the fees. A Service employee will distribute a supply of blank vouchers, along with instructions, to each Concessioner prior to the operating season. The OSV guide must submit a completed voucher at the point of entry. The Concessioner should retain one copy; the guide will turn in one copy at the entrance and keep one copy during the trip.
