- The Department of Veterans Affairs Sierra Nevada Healthcare Facility, Reno, NV 89502 intends to enter into a contract on the basis of other than full and open competition for relocating the radiology system currently located at the VA Sierra Nevada Healthcare Facility in Building 1D, Room 1D142. Equipment must be relocated to Building 1D, Room 3D100. Relocation of this system is required to vacate space for a major remodel of the Imaging Department. The system being relocated is currently under a full service maintenance agreement with Philips. As such, this system needs to be relocated by Philips to stay within the terms and conditions of the service agreement. The VA intends to award a sole source, firm fixed price contract to Philips Healthcare. This notice is not a request for competitive proposals, a solicitation, request for quotes, or potential offerors; however, interested persons may identify their interest and capabilities and respond only via email to Rusty.Stevenson@va.gov. No telephone requests will be honored. Any/all responses to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination not to compete is solely within the discretion of the Government. Justification for this sole source procurement is in accordance with FAR 6.302-1(a)(2). The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c) (1)). The NAICS used in this documentation is 238390, Other Building Finishing Contractors $14 million. The estimated date of award for this action is January 13, 2014. DEPARTMENT OF VETERANS AFFAIRS JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1.Contracting Activity: Department of Veterans Affairs, NCO 21; 2615 E. Clinton Avenue, Fresno, CA 93703. 2.Nature and/or Description of the Action Being Processed: Justification and approval for Other Than Full and Open Competition for relocating the radiology system currently located at the VA Sierra Nevada Healthcare Facility in Building 1D, Room 1D142. Equipment must be relocated to Building 1D, Room 3D100. This procurement will proceed on a sole source basis to Philips. Relocation of this system is required to vacate space for a major remodel of the Imaging Department. The system being relocated is currently under a full service maintenance agreement with Philips. As such, this system needs to be relocated by Philips to stay within the terms and conditions of the contract. This request will result in the issuance of a Firm Fixed Price Contract. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Interventional Radiology System is located at VA Sierra Nevada Health Care System (VASNHCS), 975 Kirman Avenue, Reno, NV 89502. The contractor shall furnish all labor, transportation, parts and expertise necessary to de-install, relocate, reinstall and ensure this system is fully operational. The equipment is currently located in Building 1D, Room 1D142, and it needs to be relocated to Building 1D, Room 3D100. The VA's minimum needs can only be satisfied by unique supplies or services available from only one source (41 USC 253 (c) (1)). The NAICS used in this documentation is 238390, Other Building Finishing Contractors. 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Philips Healthcare is the only authorized vendor that can perform the relocation services required. Philips is the manufacturer of this highly technical and complex diagnostic imaging system. The system being relocated is currently under a full service maintenance agreement with Philips. As such, this system needs to be relocated by Philips to stay within the terms and conditions of the contract. Philips is the only vendor that can meet statement of work for this specific repair. As stated, parts are regulated and proprietary and cannot be redistributed legally by any other vendor. There is no competition for this repair and must be facilitated by Olympus America. 6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Intent to Sole Source was posted to www.fbo.gov as a requirement; however, due to circumstances listed above in section 5, Philips is the only vendor that can meet statement of work for this specific repair. 7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Pricing is consistent with the Independent Government Cost Estimate. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: RFQ was not posted due to circumstances stated in para 5 and 6. Intent to Sole Source was posted to www.fbo.gov as a requirement only. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: No other factors apply, see stated circumstances in para 5 and 6. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
