- Sole/Single Source Justification PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the Division of Intramural Research (DIR) intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Philips Healthcare, 22100 Bothell Everett Highway, Bothell, WA 98021 for a maintenance agreement to maintain the Philips ultrasound IE33 Imaging System and probes. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $19.0 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-72. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. DESCRIPTION OF REQUIREMENT Background The mission of the Echocardiography Laboratory at the National Heart, Lung, and Blood Institute is to support clinical diagnosis and research projects relevant to cardiovascular diseases undertaken by NHLBI investigators in the Division of Intramural Research. The lab also collaboratively supports the mission of ALL of the institutes within the intramural program. The lab provides state-of-the-art cardiac ultrasound 2D and 3D exams, provides advanced data analysis, and maintains state-of-the-art ultrasound machines. Such state-of-the-art analysis includes 3D volumetric imaging, complex Strain Analysis, Tissue Motion Quantification, Parametric Quantification, Q-lab analysis, and contrast enhancement for endocardial definition. Using this equipment, the lab provides frequent training for the ICU physicians and staff. With its high resolution, specialized research software, and three-dimensional capabilities, the Philips U/S machine and probes are an essential part of daily lab operations. Purpose and Objectives The Philips equipment requires expert maintenance and repair by authorized engineers who have received thorough, specialized training and have access to the patented and proprietary details of this scientific instrument. In order to maintain Phillips ultrasound IE33 Imaging System and probes, we require a maintenance agreement. Period of Performance Maintenance agreement period of performance: 1/1/2014 - 12/31/2014 Project Description The Contractor Must: 1. Proprietary operating system software enhancements without hardware changes (excludes software upgrades) 2. Unlimited Technical Services & Clinical Applications Telephone Support 3. All labor and travel during standard hours of coverage - Mon-Fri 8am - 5pm, excluding holidays 4. Replacement of all parts (including transducers) that fail during normal use 5. Accidental Transducer Damage Protection: Coverage at 50% off the Service Exchange Program price 6. Equipment Planned Maintenance services per manufacturer specifications performed during standard hours of coverage 7. Priority scheduling for service calls and access to spare parts inventory 8. On-Board system diagnostics Reporting Requirements and Deliverables The Government Project Officer will provide general instructions on limitations and deadlines, and is responsible for administration of the task order in compliance with the contract to include inspection and acceptance of deliverables. Program Management and Control Requirements Any internal management and control systems, either specified by the Government are to be developed by the vendor/contractor. Validation, Inspection and Acceptance Requirements - Identify where inspection and acceptance will be performed. - Provide the terms or criteria for acceptance of deliverables and describe how acceptance or rejection of deliverables will be conveyed to the contractor. - Identify what is to be inspected and accepted. - Identify who will inspect and accept. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the Sole/Single Source Justification that is attached to this Notice of Intent. PHILIPS Medical Systems is the sole source of factory-authorized support for the IE33 Echocardiography/ cardiac Imaging System; and for the individual scanning probes associated with this machine. They are the only guaranteed source for parts compatible with the IE33. They are also the only vendor who can use the On-Board Diagnostic feature on the Philips IE33, allowing them to remote into the machine 24/7 (an important requirement for a lab that supports all of NIH campus with cardiac ultrasounds). CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by 3:30 PM EASTERN TIME January 27, 2014 and must reference number NHLBI-CSB-HL-2014-54-KBM.
