Modification / Amendment 0004 to Pre-Solicitation: The purpose of this modification is to answer requests for information. W912GB-14-R-0010, Italy Job Order Contract (JOC), Questions and Answers 1. Question: Could you please confirm that the requirement of S.O.A. Minor Categories can be satisfied by having these categories made available through a written agreement with suitable companies through the Italian process of quote mark avvalimento quote mark as per D.P.R. 207/2010 and D.L. 163/2006 art. 49. Since 2010 a new D.P.R. 207 was issued which supersedes the D.P.R. 34 of January 2000 mentioned in the presolicitation notice. Please clarify to which law the offeror shall obey. Answer: Although DPR 34/2000 has been superseded, the U.S. Government has not yet agreed to allow qualification by means of the quote mark avvalimento procedure. quote mark As such, the U.S. does not acknowledge that method as a means of qualification. NOTE: No more questions can be submitted after Friday, 17 January 2014 at 10:00 AM. W912GB-14-R-0010: Italy Job Order Contract (JOC): Questions and Answers 1. Question: The synopsis says that the quote mark The Solicitation will be issued on or about 15 January 2014 quote mark and that the quote mark firms shall submit material as stated below (...) no later than (...) 6 January 2014 quote mark. Answer: The original pre-solicitation notice due date was originally on 06 January 2014. The Italy Pre-Qualification due date is now extended to 30 January 2014 at 1500 hours Central European Time (CET). 2. Question: We had found out that the mandatory requirements is to have the SOA. We have noted that you do not specify an alternative for the companies of the remaining European Union Member States. We just would like to verify that you are also taking into account the equivalent industrial classifications, by including the possibility of use the equivalent classification in each of the European Union Member States, in order to proof the technical competency. Answer: The Italy Pre-Qualifications are required to be submitted prior to the issuance of the solicitation. These requirements are the country of Italy specific requirements. There are no alternatives for the remaining European Union Member States. Your firm must provide these Italy Pre-Qualifications in order to be considered. 3. Question: Reference solicitation W912GB-14-R-0010, Italy Job Order Contract. Qualification Requirements. Our company, and we believe other companies, will require updating of the SOA certification to meet the requirements in the solicitation. This process is normally a 60 to 90 day process which is made more difficult because the SOA offices will not process any documents during of Christmas and New Year holidays; from 15 December 2013 through 15 January 2014. It is impossible for any company to provide and updated and complete SOA by 6 January 2014. Request USACE Contracting extend the Italy JOC Qualification deadline until 28 February 2014 so companies can accomplish the SOA certification requirements in the solicitation. An alternative would be to release the solicitation without pre-qualification and have offerors provide their qualification documents in conjunction with their proposal due 28 February 2014. This has been done in the past. Answer: The Italy Pre-Qualification due date is now extended to 30 January 2014 at 1500 hours Central European Time (CET). 4. Question: CH2M HILL question on Item 1: in case of Prime/sub binding teaming arrangement (not a JV) please clarify whether the Prime is required to have the OG1 prevailing Category or this Category could it be in the possession of one of the team sub(s). Answer: The prime is required to pre-qualify in the prevailing category quote mark OG-1. quote mark However, if the prime is not pre-qualified in all minor categories, the subcontractor is required to be qualified in the remainder of the minor categories in order to pre-qualify for the S.O.A. requirements. quote mark The Offeror has to provide a teaming arrangement that shows how they will meet the S.O.A. requirements and letters of commitment for the proposed subcontractors. 5. Question: CH2M HILL question on Item above: Please clarify whether the quote mark Mandato quote mark is required to be submitted with the Proposal in response to the Solicitation (RFP) or not. It is our opinion that, since at the proposal stage there's no certainty of award, it is deemed not appropriate to bind irrevocably companies to JV for one (1) year, also because there are costs associated with the JV establishment and its maintenance that should be paid only after certainty of the contract award. There's also seem to be a contradiction in the clause, as the Government has the right to finally inspect and accept work and the work can only be completed at Task Order level under the Contract, so after the Contract has been awarded to the selected firm. Answer: Yes, as stated in the presolicitation, quote mark It states that the Joint Venture Offerors shall, with their proposal (not now) furnish an Italian notarized legal document ( quote mark Mandao quote mark ) that establishes the Joint Venture. quote mark This is not a negotiable answer. The Government needs proof of the Joint Venture Agreement which will be required with the proposal submission. 6. Question: IF THE PRIME CONTRACTOR HAS NO SOA CERTIFICATION IN ONLY ONE MINOR WORK CATEGORY (OG 12 CLASS II),MAY A FULLY QUALIFIED KEYSUBCONTRACTOR COVER THAT PORTION OF WORK, PROVIDED THAT ALL REQUIREMENTS ARE MET AND A LETTER OF COMMITMENT, SIGNED BY BOTH PARTIES, IS SUBMITTED? XYZ company currently holds a number of World-wide Department of State /OBO IDIQs and has strong relationships with World-class designers and contractors strategically situated regionally around the world. XYZ company self-performs a large amount of our work and we can meet any of your DD-254 requirements. By self-performing a large percentage of our OCONUS work provides better value and ensures the desired outcome for us and our clients. XYZ company is requesting information regarding the set-aside status for quote mark Z-Italy Job Order Contract (JOC), quote mark solicitation number W912GB-14-R-0010. Will the project be set-aside for specific eligible firms? If so, may we request that it be set-aside for Small Business or Women-Owned Small Business firms? Also, is it restricted to US firms only? If so, does the project call for DD 254 requirements? This information will be greatly appreciated. Thank you! Answer: Although we would be interested in working with your company, overseas we are exempt from the set aside goals and requirements. As a result your request cannot be honored. 9. Firms shall submit material as stated below that demonstrates that they meet the qualification requirements, not later than 1500 hours Central European Time (CET) on 06 January 2014. ********************************************************************************* This Pre-Solicitation Notice provides the U.S. Army Corps of Engineers, Europe District (USACE EUD) intent to award one (1) Firm-Fixed-Priced (FFP) Indefinite-Delivery Indefinite-Quantity (IDIQ) Job Order Contract (JOC) for the purpose to provide real property repair, maintenance, minor construction, and/or asbestos abatement. The orders will primarily address general building renovation, road and pavement repair, and general environmental work. This work includes, but is not limited to, incidental new minor construction, excavation, plumbing, demolition, electrical, structural, mechanical, concrete work, force protection, and environmental remedial work. The geographical area covered by this contract includes work throughout Italy but primarily in Vicenza and surrounding area, with additional work anticipated in Livorno and Aviano, Italy. This solicitation will be used to award a single Job Order Contract (JOC) to support Task Order awards of projects by the EUD District. The contract will include a base period and four (4) option periods of one (1) year duration each. Each project task order awarded under a Job Order Contract is normally comprised of a number of pre-described and pre-packed tasks as described in each Task Order and the Unit Price Book. The Government will evaluate and select, for contract award, one (1) qualified Offeror, whose Proposal is determined to be the most beneficial to the Government, with consideration given to both the technical evaluation factors and price. This solicitation will be used to award one JOC to support the EUD District through the issuance of Task Orders for various projects. Estimated cost range of this project is not-to-exceed US$25,000,000 (estimated to be US$5,000,000 per year) for the life of the contract, which will consist of one (1) base year period and four (4) option year periods. The Contract will end upon completion of the five (5) one (1) year periods or upon attainment of the US$25,000,000 capacity. Individual projects issued under the JOC will contain their own estimated values. There will be no limits on the number of task orders awarded/issued in any year. The minimum task order is 2,000 and the maximum task order is 1,000,000 (reference clause 52.216-19). On a case by case basis the Contracting Officer has the authority to issue task orders that may exceed the maximum task order limit, but not exceeding the amount of sustainment, restoration, and modernization (SRM) authority delegated to the installation by the ACOM and/or HQDA. The minimum guarantee shall be $5,000.00. This amount shall cover the duration of the entire contract (Base Period and Option Periods). The Government will post this synopsis, the solicitation, and all subsequent amendments through the Army Single Face to Industry (ASFI) Acquisition Business Web Site to the Government-Wide Point of Entry (GPE) Federal Business Opportunities (FedBizOpps) Web Site http://www.fedbizopps.gov. Approval will not be given unless the contracting officer, in the exercise of his/her sole discretion, considers the proposed substitute to be equal in all respects to the originally proposed subcontractor and the contracting officer considers the substitution to be in the best interests of the Government.
