- Sole Source Justification This synopsis is being posted to both the Federal Business Opportunities (FBO) page located at https://www.fbo.gov This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request For Quotation (RFQ) number is N66604-14-Q-0983. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-27. NAICS Code is 541511 and size standard is $25M. NUWC Division Newport intends to purchase the following items: CLIN 0001 35 Core Annual LS-DYNA License including LS-PrePost, LS-OPT, LSTC Dummy &Barrier Models, 1 Each. CLIN 0002 1st Core Annual USA Professional License, 1 Each. F.O.B. Destination Naval Station Newport; Newport, RI. It is expected to place a purchase order with Livermore Software Technology Corp (LSTC), 7374 Las Positas Road, Livermore, CA 94551. They are the only known source for these items because the software license is in support of NUWC S&T programs the Advanced Scientific and Engineering Computation Center (ASECC) which provides High-end CAD/CAM/CAE tools to support the design, structural and acoustical analysis of existing and prototype weapon systems and undersea vehicles. The software license is proprietary to LSTC and the period of performance is one year from contract award. All other timely offers will be considered. Offers for other products must submit a capability staement demonstrating an ability to met the requirement, proposal, or quote which must contain complete product information and prices. FAR 52.212-1 Instructions to Offerors--Commercial Items applies. Evaluation will be in accordance with FAR 52.212-2 Evaluation--Commercial Items. Evaluation factors are technical capability and price. Each is equally important. FAR 52.212-4, Contract Terms and Conditions--Commercial Items and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items, and DFARS 52.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items apply to this solicitation.
