- This is a Sole Source Synopsis announcement. A written solicitation will not be issued. Naval Sea Systems Command (NAVSEA) intends to award a contract with both Firm Fixed Price (FFP) items and Cost Plus Fixed Fee (CPFF) items to BAE Systems, to produce up to 966 Archerfish Neutralizers (Destructor, Mine Neutralization, Airborne EX 64 Mod 0 Archerfish, EX 65 Mod 0 Archerfish, and EX 66 Mod 0 Archerfish), Fiber Optic Spools, Neutralizer Interface Boards, Neutralizer Interface and Deployment packages, and support equipment required for the maintenance and operation of the Archerfish Neutralizer. Efforts are in support of the AN/ASQ-235 Airborne Mine Neutralization System (AMNS). This notice is provided pursuant to 10 U.S.C 2304(c)(1) and FAR part 6.302-1: the supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. A competitive procurement conducted in 2003 resulted in the Archerfish, provided by BAE, being selected as the AMNS Neutralizer. BAE Systems is the sole developer and original equipment manufacturer of the Archerfish neutralizer and related equipment. The U.S. Government does not own the rights to the technical data package and, therefore, cannot pursue a full and open competitive contract for the production of the Archerfish Neutralizer and its related equipment. This effort is a follow-on contract to continue the production of the Archerfish. Therefore, substantial duplication of cost to the Government will not be recovered through competition. The intent of this notice is not to solicit competitive offers. The proposed contract action is for supplies and services for which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, interest offerors may submit their capabilities or responses before the closing date and time of this notice to the Government for considerations. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No reimbursement will be made for any costs associated with providing information in response to this synopsis or any follow up information requests.
